- Eu green chemical legislation and its impact to cosmetic industryPublication . Pastoukhova, Polina Vassilievna; University of Lisbon; Ribeiro, Helena Margarida de Oliveira Marques; Marto, Joana MarquesResumo: A dezembro de 2019, Úrsula Von der Leyen, na qualidade de presidente da Comissão Europeia, fez um anúncio político revolucionário para ajudar a resolver os crescentes problemas ambientais que o planeta enfrenta – este foi o pacto ecológico chamado de European Green Deal, uma iniciativa ambiciosa com o objetivo de transformar a forma como a indústria regula e avalia os produtos químicos na UE através da Estratégia para a Sustentabilidade dos Produtos Químicos (Chemicals Strategy for Sustainability), um objetivo definido para ser implementado na Agenda 2030 das Nações Unidas. Esta tese fará uma revisão geral das medidas e deliberações tomadas tanto pelo setor público como pelo setor privado dentro da indústria cosmética de forma a cumprir os objetivos dispostos pelo European Green Deal, bem como discutirá como os mesmos serão alcançados através de novas alterações regulamentares, recomendações da indústria e autorregulação interna do setor, bem como definir como essas metas serão avaliadas (dentro do cronograma atual). Será apresentada uma visão geral sobre quais poderão ser as restrições, a aceitação (ou resistência) da indústria a estas mudanças, qual o impacto que terão nas matérias-primas disponíveis, nos produtos acabados, no ambiente e na nossa saúde. É discutida a revisão planeada do Regulamento dos Produtos Cosméticos (CE) nº 1223/2009 e a sua implementação planeada, e a forma como a conformidade será monitorizada. Tanto o Regulamento sobre Registo, Avaliação, Autorização e Restrição de Produtos Químicos (REACH (EC) 1907/2006) como o Regulamento sobre Classificação, Rotulagem e Embalagem de Substâncias e Misturas (Regulamento CLP) devem ser analisados de forma cruzada em conjunto com o Regulamento dos Produtos Cosméticos. Juntamente com a regulamentação dos produtos químicos, foi feita uma atualização do Plano de Ação para a Economia Circular (CEAP) em 2020. Será dada uma visão geral sobre como isto afetará a indústria cosmética, promovendo a Economia Circular desde a fase inicial de conceção do produto, até ao fim de vida dos produtos, com o objetivo de manter o máximo possível dos recursos iniciais que entram na economia da UE durante o maior tempo possível. Abstract: On December 2019 Ursula Von der Leyen, as president of the European Commission has made a revolutionary policy announcement to help tackle the growing environmental issues the planet is facing – this was the European Green Deal, an ambitious initiative with the aim to transform the way the industry regulates and assesses chemicals within the EU via the Chemicals Strategy for Sustainability, a goal set to be implemented in the United Nations 2030 Agenda. This thesis will provide an outline of the steps that will be taken by both the public and the private sector within the cosmetic industry to accomplish the European Green Deal goals, as well as discuss how they will be accomplished via new regulatory changes, industry recommendations and internal set self-regulation, as well as to define how these goals will be measured (within the current timeline). An overview will be given on what could be the constrains, industry acceptance (or resistance) to these changes, what impact it will have on the raw materials available, finished products, the environment and our health. It is discussed the planned Cosmetic Product Regulation (EC) No 1223/2009 revision and its planned implementation, and how will the compliance be monitored. Both the Registration, Evaluation, Authorisation and Restriction of Chemicals Regulation (REACH (EC) 1907/2006) and the Regulation on the Classification, Labelling and Packaging of Substances and Mixture (CLP Regulation) shall be cross analysed together with the Cosmetic Product Regulation. Alongside the chemical’s regulation, an update to the Circular Economy Action Plan (CEAP) has been made in 2020. There will be given an overview on how this will affect the cosmetic industry, by promoting CE from the early product design stage, until the end of products life, with the purpose of keeping as much as possible of the input resources within the EU economy for as long as possible.
