Preto, António Hugo Barrocas Delgado; Ferreira, Eduardo PazA presente tese inicia-se com a busca de um conceito de benefício fiscal e a tentativa de justificar a existência dos benefícios, num contexto de igualdade tributária de todos os contribuintes. Numa segunda parte do trabalho, analisaremos alguns benefícios fiscais ao sistema financeiro e mercado de capitais, os quais vão sendo comentados à medida que são apresentados. Na terceira fase, verificaremos que benefícios fiscais existem no âmbito da propriedade intelectual. Redefiniremos os moldes em que se apresenta o actual benefício fiscal à propriedade intelectual e proporemos as bases para a criação de um, até agora inexistente, beneficio fiscal para a propriedade industrial. Na quarta parte, analisaremos a situação dos incentivos fiscais à propriedade intelectual no Brasil. Faremos, em paralelo, uma comparação entre o Regime dos Auxílios de Estado no âmbito da União Europeia e da forma como estas matérias são tratadas no seio do Mercosul. Concluímos a tese defendendo uma reorientação da sociedade e da economia, por parte do Estado. Este, deverá preocupar-se menos em tornar rentável o mercado de capitais e o sistema financeiro, e centrar-se no desenvolvimento de uma política de criação de “riqueza real”, através do investimento em propriedade intelectual latu sensu.
