Abstract(s)
Neste paper tratam-se as posições jurídicas, entendidas como efeitos de normas jurídicas primarias, na aceção hartiana, em geral e como efeitos de normas de direitos fundamentais em concreto. Partindo do contributo de WESLEY HOHFELD relativo as posições jurídicas atomísticas, subsumem-se as suas conclusões aos três estatutos deônticos da norma, testando a sua resistência e corrigindo-as quando falhem.
De seguida, analisa-se individualmente cada posição jurídica usualmente apontada como atomística e conclui-se pela existência de apenas duas posições jurídicas com essa característica: o direito-pretensão e o dever, sendo o primeiro correlativo do segundo e vice-versa.
Conclui-se que o direito fundamental, enquanto conceito jurídico, não será mais do que um somatório de posições jurídicas atomísticas, i.e., um somatório de direitos-pretensão e deveres.
In this paper we cover the legal positions, understood as effects resulting from primary norms — in the sense suggested by HART — in general, and fundamental rights norms, in particular. Starting from WESLEY HOHFELD’s contributions on the matter of atomistic legal positions, we subsume the Author’s conclusions to the three deontic norm status and test their resistance, correcting them when they fail. Next, we analyse each legal position usually appointed as being atomistic and we conclude on the existence of only two legal positions sharing that characteristic: the claim-right and the duty, being the first correlate to the second and vice-versa. We conclude that the notion of fundamental right, as a legal concept, is but a summation of atomistic legal positions, i.e., of claim-rights and duties.
