O presente trabalho teve como objetivo estudar a origem e o desenvolvimento da reparação por acidentes de trabalho no Brasil e em Portugal. Com a revolução industrial e o avanço da sinistralidade laboral, tornou-se imprescindível a criação de legislação que reparasse os danos causados à nova classe trabalhadora que surgira. Com o passar dos anos essa reparação foi aprimorada para melhor se adequar à realidade social. Entretanto, durante esse processo de evolução houve a divisão do regime em duas modalidades: o regime de caráter privado e o regime de caráter público. Diante disso, buscou-se investigar o surgimento e o desenvolvimento de cada um desses regimes, bem como o histórico das legislações vigentes em Portugal e no Brasil, verificando-se o regime adotado em cada um desses países.
This study aimed to examine the origin and development of workplace accident compensation in Brazil and Portugal. With the Industrial Revolution and the rise in occupational accident rates, it became essential to create legislation to compensate the damages caused to the new working class that had emerged. This compensation system was refined over the years to better adapt to the social reality. However, during this evolutionary process, the system was divided into two modalities: the private regime and the public regime. Considering this division process, the study sought to investigate the emergence and development of each of these regimes, as well as the history of the current legislation applied in Portugal and Brazil, determining the regime adopted in each of these countries.
