Abstract(s)
A confluência entre as normas penais e contraordenacionais no que toca à qualificação de um determinado comportamento praticado pelo agente como ilícito incrementa a possibilidade de que este seja duplamente responsabilizado, em violação do ne bis in idem. Para fazer face a este problema, o legislador nacional positivou um série de normas que têm por desígnio regular o problema do concurso entre crimes e contraordenações e, de igual modo, a autoridade processualmente competente nestes casos. Não obstante a implementação daquelas soluções normativas, o tratamento das hipóteses de concurso entre infrações penais e contraordenacionais permanece uma questão controvertida.
The confluence between criminal and administrative norms, regarding the qualification of a certain conduct carried out by the defendant as illicit, increases the possibility that he will be held accountable for both offences, in violation of double jeopardy. To solve this problem, the national legislator has enacted a series of norms with the purpose of regulating the problem of the concurrence between crimes and administrative offences, and, likewise, the procedurally competent authority in these cases. Despite the implementation of those normative solutions, the treatment of concurrence between criminal offenses and administrative offenses remains a controversial issue.
