Inspirado pelo trabalho de Ronald Dworkin, Jorge Reis Novais elaborou a teoria dos direitos fundamentais como trunfos contra a maioria, que garantiria protecão maior aos direitos fundamentais. A aplicação dessa teoria resultaria em uma protecão forte do individuo em suas relações com o Estado e, em ultima análise, contra as decisões majoritárias, mesmo que submetidas aos procedimentos democráticos. Apesar deste intento, a concepção de Reis Novais apresenta uma série de contradições internas e fraquezas teóricas, além de um desacordo com a doutrina jurídica renomada e com a estrutura do sistema de direitos fundamentais. Em verdade, a teoria fragiliza demasiadamente os direitos fundamentais, dificultando qualquer efeito protetivo que poderiam garantir ao individuo quando em relação com o Estado
Inspired by Ronald Dworkin’s work, Jorge Reis Novais formulated the fundamental rights as trumps against the majority theory, which would insure a higher protection for the fundamental rights. This theory’s application would strongly protect the individual in their relation with the State and, ultimately, against the majority decisions, even when these decisions go through democratic procedures. Albeit this intent, Reis Novais’ conception presents a series of internal contradictions and theoretical weaknesses and a disaccord with renowned juridical doctrine and with the structure of the fundamental rights system. In fact, the theory unduly weakens the fundamental rights, making it difficult for the individual to receive any expected protection from them in their relation with the State.
