A crescente mobilidade humana trouxe à tona a necessidade de conciliar a proteção dos direitos fundamentais e humanos dos migrantes com as legítimas preocupações dos Estados em relação à preservação de sua soberania e segurança nacional. Essa tensão evidencia a problemática central deste trabalho, em que a prevalência do discurso securitário na formulação de políticas migratórias tem produzido efeitos de desproteção, marginalizando os compromissos internacionais voltados à dignidade do indivíduo. O problema de pesquisa, consiste em indagar de que modo a centralidade da segurança nacional contribui para a desproteção dos migrantes e quais caminhos podem ser delineados, a partir do conceito de segurança humana, para garantir o cumprimento da proteção de seus direitos. O objetivo geral pretendido é de analisar a tensão entre segurança nacional e segurança humana no contexto dos fluxos migratórios, investigando como a centralidade estatal repercute na efetividade das garantias dos migrantes e em que medida a perspectiva da segurança humana pode servir de alternativa teórica e prática. Para alcançar tal fim, foram definidos objetivos específicos, tais como, examinar a evolução do conceito de segurança e sua transição para enfoques centrados no indivíduo; avaliar mecanismos de monitoramento e gestão migratória sob a ótica da segurança nacional; investigar as fragilidades entre teoria e prática da proteção internacional dos migrantes; identificar violações decorrentes da prevalência do discurso securitário; e propor a leitura crítica da segurança humana como instrumento conciliatório entre soberania e proteção de direitos. A metodologia possui abordagem qualitativa, sendo de natureza teórico-analítica e jurídico-dogmática, com incursões críticas comparativas. O método de investigação predominantemente dedutivo, sendo utilizados como procedimentos a pesquisa bibliográfica, com levantamento de literatura especializada em Direito Internacional, Direitos Humanos e estudos sobre Segurança.
The growing phenomenon of human mobility underscores the need to reconcile the protection of migrants’ human rights with States’ legitimate concerns regarding sovereignty and national security. This study addresses the central issue that the predominance of a securitarian discourse in migration policies has produced gaps in protection, marginalizing international commitments to human dignity. The research problem is to examine how the centrality of national security contributes to migrants’ lack of protection and what role the concept of human security may play in ensuring their rights.The general objective is to analyze the tension between national and human security in the context of migratory flows, assessing how State-centered policies affect the effectiveness of guarantees afforded to migrants and to what extent human security offers a theoretical and practical alternative. Methodologically, the study adopts a qualitative, theoretical-analytical, and legal-dogmatic approach, with a predominantly deductive method and reliance on bibliographic and documentary research. The findings indicate that while protective frameworks exist, their effectiveness remains limited, reinforcing the need to reframe migration governance through the lens of human security.
