A portaria de extensão é um instrumento de regulamentação coletiva de trabalho ímpar no ordenamento jurídico português e tem vindo a desempenhar um importante papel na dinâmica das relações coletivas de trabalho, contribuindo, por exemplo, para que as taxas de cobertura por regulamentação coletiva em Portugal se mantenham elevadas, num contexto marcado pela vigência do princípio da filiação como regra basilar em matéria de eficácia das convenções coletivas de trabalho e pela existência de reduzidas taxas de sindicalização. No entanto, e ainda que desempenhe hoje este papel corretivo de algumas das vicissitudes que a aplicação pura de alguns princípios-base do sistema português de regulamentação coletiva originaria, nem sempre assim sucedeu, sendo a sua atual configuração o resultado de um processo de aprofundamento e adequação ao sistema. É precisamente tomando como ponto de partida este processo evolutivo, assim como algumas das ideias fundamentais e dos princípios em que assenta a sua estrutura, que procuraremos caracterizar a figura da portaria de extensão que vigora atualmente no ordenamento jurídico português. Essa caracterização permitir-nos-á problematizar um conjunto de questões que a aplicação deste instrumento de regulamentação coletiva de trabalho convoca, em particular no que respeita à sua aplicação subjetiva, e encontrar as soluções que melhor compatibilizam todos valores e princípios em causa. Sem prejuízo da abrangência de outros aspetos, procuraremos com a presente dissertação responder à questão central “A quem se aplica a portaria de extensão?”, assim como à questão – que, em alguns casos, daquela decorre – “A quem se aplica uma determinada portaria de extensão na dinâmica das relações laborais?”.
The extension order is a unique collective labour regulation instrument within the Portuguese legal framework and has played an important role in shaping the dynamics of collective labor relations. It has contributed, for example, to maintaining high coverage rates of collective bargaining regulation in Portugal, in a context characterized by the principle of relative applicability as a fundamental rule governing the effectiveness of collective bargaining agreements and the existence of low unionization rates. However, despite its current corrective role in addressing some of the challenges that would arise from the pure application of certain fundamental principles of the Portuguese collective regulation system, this was not always the case. Its present configuration is the result of a process of development and adaptation to the system. It is precisely by taking this evolutionary process, as well as some of the fundamental ideas and principles underpinning its structure, as a starting point that we will seek to characterize the extension order as it currently operates within our legal framework. This characterization will allow us to examine a set of issues raised by the application of this regulatory instrument, particularly concerning its subjective application. Without disregarding the range of other aspects, this master's thesis seeks to answer the central question: “To whom does the extension order apply?”, as well as to a related question, in some cases: “To whom does a particular extension order apply within the dynamics of labour relations?”.
