O objecto principal deste artigo é a contestação dos argumentos de inconstitucionalidade recentemente invocados em Portugal para sustentar a rejeição do recurso ao financiamento de contencioso por terceiros no domínio das acções colectivas representativas de grande complexidade de aplicação impositiva da concorrência e do direito do consumo através de iniciativa privada. Contesta-se, especialmente, a pretensa violação da reserva de lei e da separação de poderes, da ordem pública e da proibição do abuso de direito que, de acordo com aquelas alegações, resultaria da admissibilidade do recurso àquela modalidade de financiamento nas acções populares naquele domínio entretanto interpostas em Portugal.
The main purpose of this article is to challenge the arguments of unconstitutionality recently put forward in Portugal to support the refusal of third- party litigation funding in the area of highly complex representative actions for the protection of competition and consumer interests. In particular, the arguments according to which the alleged violation of the statutory reservation and the separation of powers, the public policy, and the prohibition of abuse of rights would be at stake if such third-party funding would be allowed in recently filed acções populares in Portugal are contested.
