A aplicação de princípios pelo juiz, pela indeterminação estrutural deste tipo de normas, potencia a sua actividade criadora do Direito ou permite-lhe uma certa discricionariedade judicial.
Com o presente trabalho pretendemos reflectir sobre o estabelecimento de métodos relativamente objectivos, constituídos por regras pré-definidas, que permitam controlar (externamente, intersubjectivamente) a actividade jurisdicional.
Para levar a cabo a nossa reflexão, seguiremos de perto Esser, Dworkin e Alexy.
Atentaremos, ainda, na aplicacão que tem sido feita, em concreto, pelo juiz administrativo, dos princípios, trazendo a discussão alguns casos judiciais.
Tentaremos, assim, apreciar a actividade jurisdicional do juiz administrativo quando
aplica princípios e o modo como essa actividade pode ser intersubjectivamente controlada
The application of legal principles by the judge, considering their structural indetermination, enhances his role in the creation of law, or gives him a wider margin of decision in his judicial activity. Our purpose with this work is to reflect on the making of fairly objective methods, comprising pre-determined rules, which allow a control (externally, intersubjectively) over the judicial activity.To carry on this task, we follow closely Esser, Dworkin and Alexy. We will also pay attention to the current usage of principles by administrative judges, bringing up some court cases. In this way, we will try to examine the activity of the administrative judge when applying principles, and how such activity can be intersubjectively controlled.
