O acórdão do TJUE, de 12 de outubro de 2017, Proc. c-218/16, tem na base um pedido de decisão prejudicial apresentado pelo tribunal Regional de Gorzów ao TJUE, sobre o reconhecimento dos efeitos reais de um legado vindicatório (legado per vindicationem) lavrado por notário polaco, cujo objeto consistia num imóvel sito em Frankfurt an der oder (Brandemburgo, Alemanha). o presente comentário tem por objetivo questionar os considerandos e postulados enunciados pelo TJUE na sua tão discutida decisão. Pretendemos, por fim, explorar os impactos da decisão do TJUE no quadro geral do Regulamento das sucessões e dos princípios de direito internacional Privado
The judgment of the ECJ of October 12, 2017, Case C-218/16, is based on a request for a preliminary ruling from the Gorzów Regional court to the ECJ, on the recognition of the real effects of a vindicatory legacy (legacy per vindicationem) drawn up by a Polish notary, whose object consisted of a building located in Frankfurt an der oder (Brandenburg, Germany). The purpose of this comment is to question the recitals and postulates stated by the ECJ in its much- discussed decision. Finally, we intend to explore the impacts of the ECJ decision in the general framework of the succession Regulation, as well as the principles of Private international law.
