Este trabalho analisa o instituto do confisco alargado no contexto internacional, com base na incorporação de uma nova política criminal nos diversos instrumentos internacionais e documentos da União Europeia. Esta nova política, que é voltada à privação dos lucros obtidos pela criminalidade organizada e pela criminalidade econômico-financeira, tem como objetivo desencorajar a prática de novos delitos e evitar a reinserção do lucro ilícito no mercado financeiro. O novo modelo de confisco impõe a busca por sua natureza jurídica e a compatibilidade com princípios e garantias penais e processuais penais. A legislação referencial é a Lei n.º 5/2002 de Portugal e sua convivência com os princípios da culpa, legalidade, presunção de inocência, proporcionalidade e propriedade. A dissertação propõe verificar a possibilidade de o ordenamento jurídico brasileiro adotar o confisco alargado, seus limites e compatibilidade com os princípios constitucionais e, lege ferenda, propor minuta de projeto de lei sobre confisco alargado.
This work analyzes the implementation of extended confiscation in an international context, based on the incorporation of a new criminal policy in several international instruments and documents of European Union. This new policy, witch focus on deprivation of profits obtained by organized crime and by economic and financial crime, aims to discourage the practice of new offenses and to avoid the reinsertion of illicit profits in financial market. The new model of confiscation imposes a search for legal nature and the compatibility with principles and criminal guarantees and criminal procedures. The referential legislation is the Law no. 5/2002 of Portugal and its coexistence with the guilt principles legality, presumption of innocence, proportionality, and property. The study proposes to verify the possibility of the Brazilian legal system to adopt the extended seizure/confiscation, its limits, and compatibility with constitutional principles and, "lege ferenda", propose a draft Bill about the extended confiscation.
