O presente artigo destina-se a explorar o âmbito e o alcance da remissão do artigo 508.º do CC para «o capital mínimo do seguro obrigatório de responsabilidade civil automóvel». De facto, apesar da aproximação feita e querida pelo legislador de 2004, o modo como funcionam e se articulam os limites máximos de responsabilidade civil objectiva e os limites mínimos de cobertura do seguro de responsabilidade civil por acidentes causados por veículos terrestres a motor continuam a não ser claros.
In the present article we intend to explore the scope and range of the remission made by the article 508 of the Civil Code to «the minimum insured sum of the mandatory motor insurance». In fact, in spite of the rapprochement made and wanted by the Portuguese legislator in 2004, the functioning and articulation between the maximum indemnity limits by the non-guilt liability for land vehicles and the minimum insured sum for the cover of civil liability for damages caused by motor land vehicles are still unclear.
