O aumento significativo do uso da tecnologia e da internet, ao mesmo tempo que aproximou as relações comerciais e econômicas entre os países, resultou no fluxo de grandes quantidades de dados pessoais sendo coletados, armazenados e eventualmente transferidos para outros países, o que demonstra a necessidade da implementação coesa de medidas de proteção entre as partes nessas relações para garantir a segurança e a privacidade das pessoas em um mundo cada vez mais digitalizado. Diante desse contexto, o presente estudo objetiva elucidar os parâmetros de justificação constitucional e legal envolvidos na transferência internacional de dados pessoais, sob a perspectiva comparativa entre a UE - notadamente sob a égide do RGPD – e o Brasil – dessa vez tendo em conta a LGPD. Para isso, portanto, primeiramente será traçado um panorama histórico para demonstrar a evolução das legislações relacionadas com o tema, assim como serão esclarecidos os principais conceitos na área, principalmente constantes das legislações supramencionadas, os requisitos para o tratamento lícito de dados, o fenômeno da transferência internacional de dados, e por fim, os princípios envolvidos no tratamento de dados. Já na segunda parte, serão analisados a aplicabilidade territorial das normativas tendo em conta o fenômeno da transferência, as partes envolvidas no processo, os instrumentos que a fundamentam e conferem legitimidade. Para finalizar, tendo por base um caso prático hipotético, para melhor elucidação, serão identificadas a aplicabilidade territorial segundo as legislações em tela, a transferência que ocorreu na ocasião, as partes envolvidas e seus respectivos papéis diante disso, assim como a notificação por violação de dados e as vias de recurso e sanções existentes diante do fato.
The significant increase in the use of technology and the internet, while simultaneously bringing countries closer in commercial and economic relations, has resulted in the flow of large amounts of personal data being collected, stored, and eventually transferred to other countries. This highlights the need for the cohesive implementation of protection measures among the countries involved in these relationships to ensure the security and privacy of individuals in an increasingly digital world. In this context, this work aims to elucidate the parameters of constitutional and legal justification involved in the international transfer of personal data, from a comparative perspective between the EU - notably under the GDPR - and Brazil - this time taking into account the LGPD. To achieve this, a historical overview will first be outlined to demonstrate the evolution of legislation related to the topic. Additionally, the main concepts in the field will be clarified, particularly those found in the aforementioned legislations, including the requirements for lawful data processing, the phenomenon of international data transfer, and finally, the principles involved in data processing. Moving to the second part, the territorial applicability of the regulations concerning the transfer phenomenon, the parties involved in the process, the instruments that underpin and confer legitimacy will be analyzed. To conclude, based on a hypothetical practical case for better elucidation, the territorial applicability according to the relevant legislation will be identified, as well as the transfer that occurred on that occasion, the parties involved and their respective roles, as well as data breach notification and the avenues for recourse and sanctions available in light of the incident.
