Abstract(s)
A busca por uma análise comparativa das concepções acerca das ações possessórias constitui-se no cerne deste estudo. Sob a perspectiva do direito civil, as ações possessórias buscam assegurar o instrumento jurídico da posse. Os entendimentos relacionados à fundamentação jurídica nas ações possessórias podem variar de um ordenamento jurídico para outro. No entanto, deve-se ter como unânime a concepção de que as referidas ações compreendem meios cabíveis para a proteção do legítimo possuidor que possa estar sendo lesado em seus direitos. A escolha do tema justifica-se pelo interesse em evidenciar o contraste entre a realidade brasileira e portuguesa no tocante às percepções sobre o instrumento jurídico da posse. Nesse ínterim, o parâmetro de comparação empregado considerou as práticas cíveis de cada país, bem como a literatura produzida. Desse modo, o presente estudo é de extrema relevância para acadêmicos, juristas e sociedade de um modo geral. O objetivo deste trabalho consiste em realizar uma análise comparativa envolvendo as abordagens doutrinárias e jurisprudenciais estabelecidas acerca das ações possessórias no Brasil e em Portugal, sob a perspectiva do direito civil em ambos os países. A metodologia utilizada neste estudo trata-se de uma pesquisa bibliográfica e documental. Para tanto, realizou-se uma análise comparativa das compreensões doutrinárias e jurisprudenciais sobre as ações possessórias nos países estudados, no âmbito do direito civil, sendo possível compreender o conceito e os tipos de posse existentes, considerando as especificidades de cada país. Nesse sentido, foram privilegiadas as concepções de diversos doutrinadores, brasileiros e portugueses, e jurisprudências que evidenciaram, em grande parte, as ações possessórias de prevenção, de manutenção e reintegração da posse, além da autodefesa. Observou-se que as ações possessórias no direito português são semelhantes às do direito brasileiro, as quais compreendem a ação de prevenção da posse, a ação de manutenção da posse e a ação de restituição da posse.
The search for a comparative analysis of the conceptions about possessory actions is at the heart of this study. From the perspective of civil law, possessory actions seek to ensure the legal instrument of possession. Understandings related to the legal basis for possessory actions may vary from one legal system to another. However, it must be unanimously conceived that these actions comprise appropriate means for the protection of the legitimate possessor who may be being harmed in his rights. The choice of the theme is justified by the interest in showing the contrast between the Brazilian and Portuguese reality with regard to the perceptions about the legal instrument of possession. In the meantime, the comparison parameter used considered the civil practices of each country, as well as the literature produced. Thus, the present study is extremely relevant for academics, lawyers and society in general. The objective of this work is to carry out a comparative analysis involving the established doctrinal and jurisprudential approaches to possessory actions in Brazil and Portugal, from the perspective of civil law in both countries. The methodology used in this study is a bibliographic and documentary research. To this end, a comparative analysis of doctrinal and jurisprudential understandings about possessory actions in the countries studied was carried out, within the scope of civil law, making it possible to understand the concept and types of existing ownership, considering the specificities of each country. In this sense, the views of several indoctrinators, Brazilian and Portuguese, were privileged, as well as jurisprudence that evidenced, in large part, possessory actions of prevention, maintenance and repossession, in addition to self-defense. It was observed that the possessory actions in Portuguese law are similar to those of Brazilian law, which include the action of preventing possession, the action of maintaining possession and the action of restitution of possession.
