A análise a ser empreendida no presente trabalho está relacionada com o debate doutrinário a respeito dos possíveis limites jurídicos para a escravização voluntária dos índios do Brasil. Mais detidamente, disporá sobre o posicionamento do Padre Manuel da Nóbrega sobre a questão ao investigar a possível incidência da visão alteritária por ele elaborada.
Diante destes pontos, os objetivos traçados dizem respeito ao enquadramento da referida visão e sua eventual influência na reflexão jurídica empreendida. Por fim, será buscada uma avaliação da contribuição do jesuíta no panorama da Segunda Escolástica Peninsular.
Assim, em resposta às interrogações inicialmente traçadas, torna-se possível a localização do tipo de vivência alteritária experimentada pelo Padre Manuel da Nóbrega. A alteridade ganhou expressão, nas palavras e ações do jesuíta, a partir da identificação do indígena como foco das suas atividades evangelizadoras devidamente asseguradas por uma “sujeição moderada”.
Quanto ao segundo questionamento, a influência da experiência alteritária se deu a partir os dados colhidos na lida missionária, em conjunção com elementos políticos e tendências religiosas que, por fim, configuraram uma postura jurídica bastante tradicional.
Nóbrega, portanto, portou-se como um agente avançado das vivências acadêmicas construídas junto às Universidades de Salamanca e Coimbra em diálogo com o território eleito para suas intervenções.
The analysis to be undertaken in the present work is related to the doctrinal debate on the possible legal limits of the voluntary enslavement of the Indians of Brazil. In more detail, it will analyze Father Manuel da Nobrega's opinion on the subject by investigating the possible incidence of his view about alteriry. In the light of these points, the stated objectives relate to the understanding of this vision and its possible influence on the legal reflection carried out. Furthermore, the contribution of the Jesuit in the area of Second Peninsular Scholasticism will be evaluated. In this way, in response to the questions raised at the beginning, it is possible to locate the type of experience of alteriry realized by Father Manuel da Nóbrega. The alteriry was expressed, in the words and actions of the Jesuit, from the identification of Indians as the focus of their evangelizing activities properly assured by a "moderate subjection." At the second questioning, the influence of the alteritary experience was based on the elements collected in the missionary work, in conjunction with political questions and religious tendencies that, in the end, formed a very traditional legal position. Nóbrega, for all that was seen, behaved like an advanced agent of the academic realities that he experimented in the Universities of Salamanca and Coimbra in dialogue with the chosen territory for its interventions.
