A regulação local da educação : os conselhos municipais de educação na definição de políticas educativas locais

Esta dissertação é o resultado de uma investigação, numa perspectiva
sociológica e organizacional, realizada nos Conselhos Municipais de Educação da
Grande Área Metropolitana de Lisboa. Nesta investigação, questionamos, o papel
dos Conselhos Municipais de Educação no quadro das novas políticas de
regulação da educação, conducente à concretização dos objectivos e finalidades
previamente definidos.
Para contextualizar esta temática, procedemos ao enquadramento teórico
e conceptual onde abordamos o fenómeno da globalização, da regulação nos
seus diferentes modos e influência na organização da educação, da organização
do Estado e do poder local, e abordamos a problemática da descentralização.
Desenvolvemos também um quadro teórico que contextualiza os Conselhos
Municipais de Educação, sendo referenciada a legislação que os regulamenta.
A metodologia adoptada neste estudo foi de natureza qualitativa, tendo por
base o paradigma Interpretativo, ínserindo-se numa abordagem do tipo estudo
extensivo. Os instrumentos de recolha de dados foram os documentos produzidos
no âmbito das reuniões dos CME e os normativos legais responsáveis pelo
enquadramento legal deste órgão.
Através da análise dos dados recolhidos foi possível concluir que os
conselhos municipais de educação estudados, dificilmente possam ser órgãos de
regulação da política educativa local pois os municípios, valendo-se da sua
legitimidade do voto, não permitem que este órgão adopte políticas que não as
por si definidas.
Nesta investigação empírica foram analisados, fundamentalmente, as
dinâmicas que nortearam a constituição dos Conselhos Municipais de Educação e
aspectos diversos relacionados com o seu funcionamento e influência na política
educativa do Município.
In this work, we used a qualitative methodology, based on the interpretative paradigm, and adopting an extensive analysis approach. The data was obtained from the documents produced during the CME reunions and from the legal norms which are responsible for the legal framing of this organ. To textualize this subject, we consider it in a theoretical and conceptual framing, approaching the globalization phenomenom, the regulation of its diferent modes and its influence in the organization of the educational process, and the balance between global and local power thus approaching the theme of decentralization. We also give a theoretical framing which encompasses the Conselhos Municipais de Educação (Municipal Educational Councils) referencing the legislation that regulates them This essay is the result of an investigation, following both a social and an organic view, focused on the Conselhos Municipais de Educação (Education Municipal Councils) in the metropolitan area of Lisbon. In this investigation, we studied the role of the CME in the setting of the new politics of regulation in theeducation field, and to which extent they lead to the fulfillment of the aims and purposes previously defined for these organs. In this empirical investigation, we analyzed, mainly, the dynamics which guided the constitution of the CME (Conselhos Municipais de Educação - Municipal Education Councils) and different subjects related to their working procedures and influence on the educational politics of the Municipality. Through the analysis of the obtained data we arrived to the conclusion that the studied CME's could hardly be instrumental in the regulation of the local educational politics since the municipality, using its due right to veto, won't allow the CME to enforce politics which are not endorsed by the municipality itself.
