O presente estudo examina o entendimento do Tribunal Europeu de Direitos Humanos acerca das devoluções sumárias (pushbacks) de estrangeiros nas fronteiras terrestres — prática que consiste em afastar forçosamente o estrangeiro sem a análise de suas circunstâncias individuais e, por vezes, à margem de qualquer procedimento formal. A pesquisa analisa a jurisprudência do Tribunal para verificar se este adota uma abordagem comprometida com a defesa dos direitos humanos, especialmente no que diz respeito à
proibição de expulsões coletivas e ao princípio de non refoulement, à luz da tensão existente entre tais garantias e a prerrogativa estatal de controlar suas fronteiras.
The present study examines the European Court of Human Rights' understanding of summary returns (pushbacks) of foreign nationals at land borders — a practice that involves forcibly removing foreign nationals without assessing their individual circumstances and, at times, outside the framework of any formal procedure. The research analyzes the Court's jurisprudence to determine whether it adopts an approach committed to the protection of human rights, particularly regarding the prohibition of collective expulsions and the principle of non-refoulement, in light of the tension between these guarantees and the State's prerogative to control its borders.
