Essa dissertação investiga o desenvolvimento do direito ao esquecimento no Brasil, com foco no conflito entre dois direitos fundamentais no contexto da era digital: o direito à privacidade e à liberdade de expressão. Inicialmente, a dissertação discute as implicações éticas e jurídicas de se permitir o esquecimento de informações pessoais, abordando tanto os perigos que podem surgir quando tentamos apagar o passado quanto os benefícios do esquecimento como uma ferramenta de recomeço e de construção da identidade pessoal. A pesquisa também examina como a era digital redefine o conceito de privacidade e contextualiza a liberdade de expressão como um pilar da democracia que, ao mesmo tempo, pode ser restringida em casos específicos. O estudo parte da análise de casos internacionais e brasileiros, oferecendo uma crítica à decisão proferida pelo Supremo Tribunal Federal brasileiro no ano de 2021. A dissertação conclui com a apresentação de algumas propostas doutrinárias para a regulamentação do direito ao esquecimento.
This dissertation investigates the development of the right to be forgotten in Brazil, focusing on the conflict between two fundamental rights in the context of the digital age: the right to privacy and freedom of expression. Initially, the dissertation discusses the ethical and legal implications of allowing the forgetting of personal information, addressing both the dangers that can arise when we try to erase the past and the benefits of forgetting as a tool for starting over and building personal identity. The research also examines how the digital age redefines the concept of privacy and contextualizes freedom of expression as a pillar of democracy that, at the same time, can be restricted in specific cases. The study starts from the analysis of international and Brazilian cases, offering a critique of the decision handed down by the Brazilian Supreme Federal Court in 2021. The dissertation concludes with the presentation of some doctrinal proposals for the regulation of the right to be forgotten.
