| dc.description.abstract | Essa dissertação investiga a função consultiva do Tribunal Internacional de Justiça por meio do estudo de caso: Consequências jurídicas da separação do Arquipélago de Chagos de Maurício em 1965. Argumenta-se a efetividade prática da função consultiva, uma vez que não possui efeito vinculante. A análise parte da origem do Tribunal Internacional de Justiça para delinear a fundamentação jurídica da função consultiva e avança para avaliar sua característica política inerente. A dualidade da função, simultaneamente jurídica e política, determina os limites de sua própria aplicabilidade. O caso do arquipélago de Chagos ilustra o tema, nele foram avaliados o processo de descolonização das Ilhas Maurício, ex-colônia britânica, e a legalidade da separação de seu território quando de sua independência, concluindo pela ilegalidade da separação e determinando a soberania de Maurício sobre Chagos. O pedido de parecer encontrou relutância quando da votação em plenário na Assembleia Geral das Nações Unidas, em especial de antigas metrópoles, e novamente após concluído o parecer, quando da adoção da Resolução 73/295, para acolher e aplicar o entendimento do Tribunal. Contudo, evidencia-se a natureza persuasiva dos pareceres, que, embora não vinculantes, carregam autoridade. O caso Maurício/Maldivas perante o Tribunal Internacional do Direito do Mar, onde o entendimento sobre a soberania de Chagos foi determinante, demonstra como o parecer do TIJ pode influenciar decisões contenciosas, reforçando a relevância da competência consultiva como instrumento de orientação jurídica e de desenvolvimento do direito internacional. | pt |
| dc.description.abstract | This dissertation investigates the advisory function of the International Court of Justice through the case study: Legal Consequences of the Separation of the Chagos Archipelago from Mauritius in 1965. It argues the practical effectiveness of the advisory function, notwithstanding its lack of binding effect. The analysis begins with the origins of the International Court of Justice to delineate the legal foundation of the advisory function and proceeds to assess its inherent political nature. The duality of the function, simultaneously legal and political, determines the limits of its own applicability. The Chagos Archipelago case illustrates this theme; it involved an evaluation of the decolonization process of Mauritius, a former British colony, and the legality of the separation of its territory at the time of its independence, concluding that the separation was illegal and determining Mauritius' sovereignty over Chagos. The request for an advisory opinion met with reluctance during the plenary vote at the United Nations General Assembly, particularly from former colonial powers, and again after the opinion was issued, during the adoption of Resolution 73/295 to endorse and implement the Court's understanding. However, the persuasive nature of advisory opinions is evident; although non-binding, they carry authority. The Mauritius/Maldives case before the International Tribunal for the Law of the Sea, where the understanding regarding sovereignty over Chagos was decisive, demonstrates how an ICJ advisory opinion can influence contentious decisions, reinforcing the relevance of advisory jurisdiction as an instrument for legal guidance and the development of international law. | en |
