Abstract(s)
Esse trabalho pretende abordar sobre o direito de alimentos devidos aos filhos menores, especialmente nas situações em que os progenitores dos mesmos estejam separados de facto, ou não vivam mais em situações materialmente análogas às dos cônjuges.
Isso porque, o direito de alimentos é um dos mais importantes e elevados direitos resguardados para todas as crianças e jovens pelo ordenamento jurídico português.
Assim, ao longo deste presente trabalho, iremos nos debruçar sobre as mais diversas problemáticas envolvendo esta questão.
Para isto, será realizada uma breve abordagem sobre os direitos fundamentais garantidos as crianças, bem como uma análise mais pormenorizada sobre o regime das responsabilidades parentais e os poderes-deveres delas provenientes.
Posteriormente, será analisado também acerca do regime de alimentos e, portanto, sobre sua conceituação, suas principais características, sua fundamentação, fixação e determinação. Ademais, também serão abordadas sobre as diferentes situações que podem surgir em decorrência da obrigação de alimentos, tais como: o incumprimento deste dever e as medidas preventivas e coercitivas previstas pelo ordenamento jurídico português para estes casos; o crime de violação da obrigação de alimentos; e as formas de alterar e cessar a obrigação alimentícia ora fixada.
Por fim, no último capítulo deste presente trabalho, também será analisado acerca da criação do Fundo De Garantia de Alimentos Devidos a Menores (FGADM) e a importância que o mesmo representa como forma de substituição do dever de prestar alimentos aos menores.
Posto isto, serão observados os pressupostos e requisitos necessários para a intervenção do FGADM, assim como as problemáticas e as divergências doutrinárias e jurisprudenciais oriundas desta questão.
Ademais, também serão abordadas algumas dúvidas quanto à fixação da prestação de alimentos ao Fundo, o limite quantitativo desta prestação, o momento no qual se inicia esta obrigação e os motivos de cessação do dever de prestar alimentos pelo FGADM.
This work aims to address the right to maintenance due to minor children, especially in situations where their parents are de facto separated or no longer living in situations materially analogous to those of their spouses. This is because the right to food is one of the most important and highest protected rights for all children and young people in the Portuguese legal system. Therefore, throughout this work, we will focus on the most diverse problems involving this issue. To this end, a brief approach will be made on the fundamental rights guaranteed to children, as well as a more detailed analysis on the regime of parental responsibilities and the powers that come from them. Afterwards, it will also be analyzed about the diet of food and, therefore, about its conceptualization, its main characteristics, its rationale, fixation and determination. In addition, the different situations that may arise as a result of the maintenance obligation will also be addressed, such as: the failure to comply with this duty and the preventive and coercive measures provided by the Portuguese legal system for these cases; the crime of violation of the maintenance obligation; and the ways to alter and terminate the maintenance obligation now established. Finally, the last chapter of this present work will also analyze the creation of the Guarantee Fund for Food Owed to Minors (FGADM) and the importance it represents as a means of replacing the duty to provide food to minors. That said, the assumptions and requirements necessary for the intervention of FGADM will be observed, as well as the problems and doctrinal and jurisprudential divergences arising from this issue. In addition, some doubts will also be addressed regarding the establishment of maintenance payments to the Fund, the quantitative limit of this payment, the time at which this obligation begins and the reasons for the termination of the duty to provide maintenance by FGADM.
