A justiça penal portuguesa tem vindo a relevar-se frágil perante os novos desafios que lhe têm sido colocados pela evolução e transformação da sociedade, face aos problemas colocados pelo aumento e desenvolvimento da alta criminalidade e criminalidade organizada. Neste âmbito, o fenómeno da corrupção em Portugal tem apresentado desafios significativos, especialmente devido às dificuldades probatórias decorrentes da natureza oculta e complexa desse tipo de criminalidade. Embora exista uma vasta legislação destinada a combater o fenómeno, a sua aplicação prática enfrenta obstáculos, como a falta de recursos investigativos e a dificuldade em reunir provas sólidas, já que os crimes são frequentemente praticados em segredo, sem vítimas diretas. O presente estudo analisa as características probatórias dos crimes de corrupção, as limitações das estratégias atuais e explora possíveis soluções, como a colaboração premiada.
The Portuguese criminal justice system has proven to be fragile in the face of the new challenges posed by the evolution and transformation of society, in the face of the problems posed by the increase and development of high crime and organized crime. In this context, the corruption phenomenon in Portugal has presented significant challenges, especially due to the evidentiary difficulties arising from the hidden and complex nature of this type of crime. Despite the existence of extensive legislation aimed at tackling the phenomenon, its practical application faces obstacles, such as the lack of investigative resources and the difficulty in gathering solid evidence, since the crimes are often carried out in secret, without direct victims. This study analyzes the evidentiary characteristics of corruption crimes, the limitations of current strategies and explores possible solutions, such as award-winning collaboration.
