A alienação parental é fenômeno no qual um dos genitores, após a separação com o cônjuge passa a manipular a prole, em uma campanha de difamação realizada no intuito de afastar a criança do genitor alienado, colocando-a em meio a um conflito ocasionado pelo fim da relação. A manipulação exercida é prejudicial a criança, podendo ocasionar problemas psicológicos graves, devendo ser combatida pela família, pelo Estado e o Direito. O presente estudo objetiva a análise da necessidade de criminalização da conduta como um mecanismo de frear a sua ocorrência, haja vista que o referido comportamento é danoso à criança e viola uma série de direitos fundamentais, como o direito à dignidade, saúde, ao livre desenvolvimento da personalidade e outros. Assim, o problema a ser estudado envolve o tratamento a ser dado, pelo Direito, à alienação parental, principalmente em termos de tipificação criminal, vislumbrando discutir o melhor caminho a ser adotado na busca da redução de sua ocorrência e proteção das crianças e adolescentes. Para tanto, será realizada uma análise qualitativa, utilizando a técnica de pesquisa bibliográfica e documental, que engloba a investigação embasada em legislações, doutrinas, jurisprudências e exemplos, considerando, ainda, as abordagens adotadas pelos países, com ênfase em Portugal e Brasil. Da análise das legislações, dos princípios do Direito, das jurisprudências, doutrinas e da realidade social que perpassa o tema, concluiu-se que a criminalização da alienação parental não é a medida mais adequada e eficaz para solucionar o problema, devendo-se buscar soluções que assegurem a convivência familiar da criança com os genitores sempre que possível. Nesse contexto, é fundamental a conscientização da população acerca dos efeitos da alienação sobre a criança, além da capacitação dos profissionais da área jurídica e de uma equipe multidisciplinar para determinar, em cada caso, qual a melhor abordagem a ser adotada visando o reequilíbrio do ambiente familiar.
Parental alienation is a phenomenon where one of the parents, after separation from the spouse, starts to manipulate the child, defaming the other relative to distance the child from them, placing the child in the midst of a conflict caused by the end of that relationship. Manipulation is harmful to the child, and can cause serious psychological problems, that’s why it must be repressed by the family, State and Law. This study aims to analyze the need to criminalize parental alienation as a mechanism to curb its occurrence, given that this behavior is harmful to the child and violates a series of fundamental rights, such as dignity, health, the right to free development of personality and others. Thus, the problema to be studied involves how Law should regulate parental alienation, mainly in terms of criminal classification, discussing the best way to reduce its occurrence and to protect the children and teenagers. Therefore, a qualitative analysis will be carried out, using the technique of bibliographical and documental research, with research based on legislation, doctrines, jurisprudence and examples, also considering the approaches adopted by the countries, with emphasis on Portugal and Brazil. From the analysis of legislation, principles of law, jurisprudence, doctrines and the social reality that permeates the matter, it was concluded that the criminalization of parental alienation is not the most appropriate and effective measure to solve the problem, and the solution must ensure the family coexistence of the child with the parents whenever possible. In this context, it is fundamental to make the population aware of the effects of alienation on the child, as well as training professionals in the legal area, as well as prepare a multidisciplinary team to determine, in each case, the best approach to rebalance the family environment.
