O surgimento da sociedade da informação deslocou a comunidade para um único local onde a comunicação é o elemento essencial para o desenvolvimento deste novo tipo de sociedade. No entanto, a privacidade dos usuários e suas informações estão ameaçadas pela própria característica da rede. Com o surgimento de um novo ambiente, novos problemas jurídicos afloram e, novas formas de soluciona-los são necessárias, forçando o legislador a reconsiderar as soluções dadas ao mundo antigo e aplicá-la ao novo mundo. Diante deste cenário, em benefício da segurança dos usuários da internet e, própria defesa do Estado é necessário buscar uma solução no sentido de uma harmonização adequada dos interesses do Estado na persecução penal, proteção dos cidadãos, e, a tutela dos direitos fundamentais. É nesta perspectiva que nos propomos analisar as ações encobertas no mundo virtual como forma eficaz no enfrentamento da criminalidade, sobretudo da criminalidade organizada e violenta. Este trabalho é fruto de uma investigação desenvolvida no âmbito do direito processual penal, direitos fundamentais e, direito à privacidade e sociedade da informação. Buscamos com a presente dissertação dar nosso contributo para que as ações encobertas na internet encontrem o seu caminho, superando as dificuldades e seja visto como um novo método de investigação criminal.
The emergence of the information society shifted the community to a single place where communication is the essential element for the development of this new type of society. However, the privacy of users and their information is threatened by the very feature of the network. With the emergence of a new environment, new legal problems arise, and new ways of solving them are necessary, forcing the legislator to reconsider the solutions given to the ancient world and apply it to the new world. Given this scenario, it is necessary to seek a solution in the sense of an adequate harmonization of the interests of the State in the criminal prosecution, protection of citizens, and the protection of fundamental rights. It is in this perspective that we propose to analyze the covert actions in the virtual world as an effective way to fight against crime, especially organized and violent crime. This work is the result of research carried out in the area of criminal procedural law, fundamental rights and the right to privacy and the information society. We seek with this dissertation to make our contribution so that the hidden actions on the Internet find their way, overcoming difficulties and be seen as a new method of criminal investigation.
