A negociação colectiva europeia é o processo de negociação que se realiza entre sindicatos e organizações de empregadores europeus, com vista à regulação dos termos e condições de trabalho dos trabalhadores dos Estados-Membros da União Europeia. É um processo que visa a elaboração e celebração de normas de cariz social, em especial convenções colectivas europeias. As convenções colectivas europeias, em conjunto com os objectivos do diálogo social europeu, pretendem implementar padrões mínimos de condições de trabalho que vinculem todos os Estados-Membros, numa lógica de harmonização legal dos objectivos sociais da União Europeia. Pretendemos, portanto, analisar o processo de negociação colectiva europeia, bem como de celebração de convenções colectivas europeias e sua implementação nos ordenamentos jurídicos nacionais.
The European collective bargaining is the negotiation process that takes place between trade unions and employers' organizations in Europe, in order to regulate employment terms and conditions of workers from Member-states of the European Union. It is a process aimed at drawing up and concluding social norms, especially European collective agreements. European collective agreements, together with the objectives of the European social dialogue, are intended to implement minimum standards of working conditions that bind all Member-States, in a logic of legal harmonization of European Union’s social objectives. We intend to analyze the process of European collective bargaining, as well as European collective agreements and their implementation in national laws.
