A presente dissertação visou analisar e explanar o conceito de habitat urbano na qual se insere o direito à habitação que, à luz do novo quadro legal afiança resolver a atual grave crise de habitação, por um lado. Por outro lado, e em simultâneo, pretende romper com o clássico direito a um teto, alargando este direito à zona envolvente onde se localiza a habitação, concebendo uma melhoria quanto ao seu conteúdo, ao relacionar com a qualidade de vida dos cidadãos.
Esta nova abordagem só terá utilidade real se os atores com responsabilidade na prossecução de políticas públicas nacionais e locais de habitação, entenderem o potencial deste conceito não só para o desenvolvimento urbano, mas sobretudo, para combater a segregação territorial e social.
Propõe-se, assim, expor as fragilidades e os desafios que se colocam na aplicação prática da lei de bases de habitação, sobretudo na sua articulação com as demais políticas públicas e com os instrumentos jurídicos nacionais e supranacionais, bem como salientar o papel daqueles atores na promoção e efetivação do direito ao habitat que se quer para todos e para cada um.
Mais do que olhar para o passado, considerando que a lei de bases ainda está a ser regulamentada através de alterações aos regimes jurídicos que com ela se articulam, pretende-se aqui contribuir para o debate sobre a relevância do habitat urbano para a concretização do direito à habitação enquanto política pública de habitação 2.0. cujos resultados ainda estão por surgir.
The present dissertation aimed to analyze and explain the concept of urban habitat in which the right to housing is inserted, which, in the light of the new legal framework, guarantees to solve the current serious housing crisis, on the one hand. On the other hand, and at the same time, it intends to break with the classic right to a roof, extending this right to the surrounding area where the housing is located, conceiving an improvement in its content, by relating it to the quality of life of citizens. This new approach will only be of real use if the actors with responsibility for the pursuit of national and local public housing policies understand the potential of this concept not only for urban development, but above all, to combat territorial and social segregation. It is thus proposed to expose the weaknesses and challenges that arise in the practical application of the basic housing law, especially in its articulation with other public policies and with national and supranational legal instruments, as well as to highlight the role of those actors in the promotion and implementation of the right to habitat that is wanted for each and every one. More than looking to the past, considering that the basic law is still being regulated through changes to the legal regimes that are articulated with it, it is intended here to contribute to the debate on the relevance of urban habitat for the realization of the right to housing as a public housing policy 2.0. the results of which are yet to emerge.
