O presente texto constitui um breve comentário ao acórdão do tribunal da Relação de Lisboa de 11.11.2020, o qual assume importância teórica e prática e manifesta atualidade. nele se discute um dos primeiros casos ocorridos em Portugal de apresentação de um pedido de habeas corpus fundado em decisão de isolamento profilático considerada ilegal, suscitando-se a questão de saber se uma decisão dessa natureza pode ser entendida como uma decisão privativa de liberdade e, em caso afirmativo, se contra a mesma pode ser usada a providência de habeas corpus, baseada em detenção ilegal.
The following text constitutes a brief comment on the judgment of the Lisbon court of appeals of 11.11.2020, which has theoretical and practical importance and is clearly up to date. it discusses one of the first cases occurred in Portugal of filing a request for habeas corpus based on a prophylactic isolation decision which has been considered illegal, raising the question of whether a decision of this nature can be understood as a decision involving deprivation of freedom and, if so, if na habeas corpus can be used against it, based on illegal detention.
