A valoração da prova irrepetível no processo penal brasileiro apresenta desafios significativos, especialmente sob a ótica do artigo 155 do Código de Processo Penal, e a natureza desse tipo de prova que tem origem dentro do sistema inquisitorial do Inquérito Policial, cujo contraditório é postergado para a fase processual de forma ineficaz. A decisão de mérito pelo juiz, que teve contato com o conteúdo produzido nas investigações, será formada conforme o princípio do livre convencimento motivado e conduzida pela Teoria da Dissonância Cognitiva, razão pela qual se demonstra a relevância do juiz de garantias, inspirado no modelo italiano, como uma solução para evitar a contaminação do julgador pelas informações preliminares. Os sistemas de valoração da prova da Alemanha e da Itália oferecem alternativas para minimizar os riscos de parcialidade e garantir maior justiça no uso de provas irrepetíveis, observando que os diferentes tipos de prova têm peso para determinadas decisões. Assim, reforça-se a necessidade de padrões rigorosos de admissibilidade e de mecanismos que assegurem os direitos fundamentais e a imparcialidade no sistema jurídico brasileiro.
The evaluation of non-repeatable evidence in Brazilian criminal proceedings presents significant challenges, especially from the perspective of Article 155 of the Code of Criminal Procedure, and the nature of this type of evidence, which originates within the inquisitorial framework of the Police Inquiry, where adversarial proceedings are postponed to the trial phase in an ineffective manner. The judge's decision on the merits, having been exposed to the content produced during the investigations, is formed according to the principle of freely motivated conviction and guided by the Theory of Cognitive Dissonance. This highlights the importance of the juiz de garantias (guaranteeing judge), inspired by the Italian model, as a solution to prevent the contamination of the judge by preliminary information. The evidentiary assessment systems in Germany and Italy offer alternatives to minimize the risks of bias and ensure greater fairness in the use of non-repeatable evidence, recognizing that different types of 5 evidence carry varying weights for specific decisions. Thus, the need for strict admissibility standards and mechanisms to safeguard fundamental rights and impartiality in the Brazilian legal system is underscored.
