O presente trabalho pretende analisar a repercussão do Programa de Acessibilidade implantado pelo Tribunal Regional Eleitoral do Ceará desde o ano de 2010 como instrumento de fomento ao direito ao voto da Pessoa com Deficiência no município de Fortaleza, Ceará, Brasil. Para alcançar esse objetivo, preconizou-se o estudo das diretrizes internacionais (tratados e convenções de organismos internacionais oficiais) e da sua respectiva harmonia com a legislação brasileira em geral e em especial com o Estatuto da Pessoa com Deficiência, a identificação das barreiras existentes que impedem a pessoa com deficiência de votar, bem como o estudo da situação atual dessas barreiras no município de Fortaleza. Para tanto, foi realizada pesquisa bibliográfica por meio da utilização de dados cientificamente reconhecidos em artigos, doutrinas, livros e periódicos, além da aplicação de questionário virtual utilizando o método de pesquisa survey de forma exploratória. Como principal limitação metodológica encontrada, aponta-se a pandemia do Novo Coronavírus, que impediu a aplicação presencial dos questionários por conta das regras impostas pelo governo local de distanciamento social e lockdown. A partir da análise dos dados levantados pelo questionário, foi possível depreender que o Programa de Acessibilidade é um instrumento de estímulo relevante para a promoção do voto da pessoa com deficiência, de forma que mais da metade dos respondentes indicou ter votado com a acessibilidade necessária. Conclui-se que o Tribunal Regional Eleitoral do Ceará logrou êxito no seu propósito de viabilizar o exercício do voto pelas pessoas com deficiência e Fortaleza até o presente momento e demonstra potencial para realizar mudanças futuras mais robustas e de maior relevância.
The present work intends to analyze the repercussions of the Accessibility Program implemented by the Regional Electoral Court of Ceará since 2010 as an instrument to promote the right to vote of the Person with Disabilities in the city of Fortaleza, Ceará, Brazil. In order to achieve this objective, the study of international guidelines (treaties and conventions of official international organizations) and their respective harmony with Brazilian legislation in general and in particular with the Statute of Persons with Disabilities, the identification of existing barriers that prevent the disabled person to vote, as well as the study of the current situation of these barriers in the city of Fortaleza. For this, bibliographic research was carried out using scientifically recognized data in articles, doctrines, books and journals, in addition to the application of a virtual questionnaire using the survey research method in an exploratory way. As the main methodological limitation found, we point out the New Coronavirus pandemic, which prevented the face-to-face application of the questionnaires motivated by the rules imposed by the local government of social distance and lockdown. From the analysis of the data collected by the questionnaire, it was possible to conclude that the Accessibility Program is a relevant stimulus instrument for promoting the vote of people with disabilities, so that more than half of the respondents indicated that they had voted with the necessary accessibility. It is concluded that the Regional Electoral Court of Ceará was successful in its purpose of making the exercise of voting by people with disabilities and Fortaleza feasible up to the present moment and demonstrates the potential for making greater and more relevant future changes.
