Este comentário analisa o Acórdão de 11 de dezembro de 2020 do Tribunal Internacional, relativo ao diferendo que opôs a Guiné Equatorial à França no tocante à oposição da última quanto à qualificação como local da missão diplomática da primeira de um determinado edifício na capital francesa. O Tribunal, numa decisão muito dividida, veio considerar que a escolha dos locais da missão pelo Estado acreditante pode ser objetada pelo Estado acreditador, fundando-se no princípio do mútuo consentimento, presente no desenvolvimento de relações diplomáticas bilaterais.
This commentary examines the Judgment of december 11, 2020, of the international Court of Justice, concerning the dispute between equatorial Guinea and France regarding the opposition of the latter about the qualification of a certain building in the French capital as premises of the diplomatic mission of the former. The court, in a very divided decision, came to consider that the choice of mission premises by the sending State may be objected to by the receiving State, based on the principle of mutual consent, present in the development of bilateral diplomatic relations
