A Internet foi concebida como um projeto no final da década de 1960 pela Agência de Projetos de Pesquisa Avançada (ARPA) do Departamento de Defesa dos Estados Unidos, através da necessidade de criação uma rede de comunicação descentralizada e resistente a ataques. Inicialmente denominada ARPANET, conectou instituições de pesquisa e bases militares, utilizando tecnologia de comutação de pacotes para transmitir dados. Ao longo das décadas, evoluiu para uma rede global que liga milhares de milhões de dispositivos em todo o mundo, revolucionando a comunicação, o comércio e o acesso à informação. A sua estrutura permitiu a conectividade sem precedentes entre indivíduos e organizações ultrapassando fronteiras geográficas e culturais.
Ocorre que tal evolução trouxe consigo um enorme desafio para o Direito: regulamentar esta ferramenta em constante expansão. À medida que a tecnologia continua a avançar, maior é o desafio para a Governança do ciberespaço, o que demonstra a necessidade de esforços colaborativos entre governos, empresas tecnológicas e sociedade civil para regular neste cenário digital por meio do Direito Internacional.
The Internet was conceived in the late 1960s by the Advanced Research Projects Agency (ARPA) of the United States Defense Department, due the need to create a decentralized and attack-resistant communication network. The project called ARPANET, connected research institutions and military bases, using packet switching technology to transfer data. Over the decades, it has developed into a global network that connects billions of devices around the world, revolutionizing communication, commerce and access to information. Its structure allowed unprecedented connectivity between individuals and organizations across geographic and cultural boundaries. It turns out that this evolution brought with it an enormous challenge for Law: regulating this constantly expanding tool. As this technology continues to advance, the challenge for the Governance of cyberspace becomes bigger, which demonstrates the need for collaborative efforts between governments, technology companies and society to regulate this scenario through International Law.
