| dc.description.abstract | O presente trabalho tem como objetivo maior apresentar o processo de globalização das relações internacionais desenvolvidas entre Estados e entes internacionais, de forma a compreender os efeitos provocados na estrutura do Estado Moderno, em especial, na organização e execução de funções públicas por meio das alternativas oferecidas pela governança global. Apresenta-se, assim, uma série de razões e contruções jurídicas que organizadas desencadearam a atual conformação das relações estatais internacionais. Busca-se, igualmente, compreender de que forma se estruturam atualmente as relações internacionais e por meio de que instrumentos são efetivadas. Discute-se a mudança de paradigma sobre a vinculação da competência estadual ao território nacional face ao processo de globalização. Identifica-se que na conformação global atual governos estatais têm enfrentado dificuldades para cumprir suas obrigações fundamentais, previstas na legislação nacional e nos compromissos internacionais firmados. Dessa forma, analisa-se possíveis medidas a serem adotadas para erradicação desses problemas. Pretende-se com este trabalho solucionar questionamentos acerca das implicações da globalização no processo clássico de governança, bem como sobre o papel e contribuição dos Estados e entidades internacionais. Busca-se, igualmente, discutir certas estruturas de atuação conjunta e interconectada dos Estados e entidades internacionais no âmbito global. Por fim, pretende-se identificar alguns entraves existentes ao desenvolvimento da governança global e sugestionar alternativas de mitigação e até solução. | pt_PT |
| dc.description.abstract | The main purpose of this paper is to present the globalization process of international relations developed between States and international entities, in order to understand the effects on the structure of the Modern State, especially, in the organization and execution of public functions through the alternatives offered by the governance. This presents a series of reasons and legal theoric constructions that have organized the current shape of international state relations. It also seeks to understand how international relations are structured today and through which instruments are implemented. It discusses the paradigm shift on state competency linked to the national territory in face of the globalization process. It is identified that in the current global conformation, state governments have faced difficulties to fulfill their fundamental obligations, provided for in national legislation and in their agreed international commitments. In this way, it is analyzed possible measures to be adopted to eradicate these problems. The aim of this paper is to solve questions about the implications of globalization in the classic governance process, as well as on the role and contribution of the States and international entities. It also seeks to discuss certain structures of joint and interconnected action of States and international entities at the global level. Finally, it intends to identify some current obstacles to the development of global governance and to suggest alternatives for mitigation and even solution. | en |
