Abstract(s)
A ACT tem uma função inspectiva muito relevante no âmbito das condições de trabalho, contudo, principalmente em legislação recente, têm-lhe sido atribuídas funções para-jurisdicionais, prevendo-se inclusive que o inspector de trabalho possa decidir em matéria da exclusiva competência de tribunais judiciais.
Considerando a multiplicidade de atribuições e os poderes conferidos aos inspectores da ACT, há que ponderar a correspondente responsabilidade civil, atenta a máxima: quanto mais poder maior a responsabilidade.
ACT has a very relevant inspection duty in the area of labour conditions, however, specially in recent legislation, it has been receiving para-jurisdictional duties, namely being foreseen that the labour inspector can decide in matters of the exclusive competence of the courts. Given the multiple duties and powers granted to the ACT inspectors, the correspondent civil liability must be considered, given the maxim: the greater the power, the greater the responsibility.
