| dc.description.abstract | O escopo principal da presente dissertação de mestrado corresponde a uma análise do enquadramento jurídico internacional que é feito do direito de participação política das mulheres na Guiné-Bissau, na perspetiva do Sistema de proteção dos direitos humanos de vocação universal, nomeadamente, da Organização das Nações Unidas e de vocação regional (africana) nomeadamente a União Africana. A inclusão equitativa de homens e mulheres na vida política, tendo em consideração o princípio de igualdade material consagrado em todos os instrumentos jurídicos de proteção dos direitos humanos, tem um impacto muito importante na definição e execução de políticas públicas nacionais que correspondam ao interesse dos dois grupos. No entanto, apesar de as mulheres constituírem o género predominante do total da população mundial, encontram-se pouco representadas nas esferas de tomadas de decisão dos seus países. Com a realização deste estudo, procurou-se identificar e analisar os direitos que lhes são conferidos pelos instrumentos jurídicos internacionais que visam proteger e promover os seus direitos humanos, de modo geral e particularmente o seu direito de participação política nas estruturas formais de poder. O presente trabalho dedicou-se ao estudo do caso da Guiné-Bissau, onde comparou-se o estipulado em tais instrumentos jurídicos internacionais e nacionais com a realidade vivida pelas mulheres guineenses. Também se procurou, com o presente estudo, diagnosticar os obstáculos à participação das mulheres na política na Guiné-Bissau e em que medida estes obstáculos contrariam as disposições previstas nos instrumentos jurídicos internacionais de proteção dos direitos humanos das mulheres. Da investigação realizada, concluiu-se que a Guiné-Bissau não tem conseguido respeitar os seus compromissos jurídicos internacionais nesta matéria, devido a uma diversidade de obstáculos que devem a sua existência a razões de natureza política, jurídica, social, económica, mas, essencialmente de natureza cultural, devido aos estereótipos impostos pela sociedade e à pratica de usos e costumes que contrariam a lei e que constituem violações graves dos direitos humanos das mulheres, limitando consideravelmente o seu acesso ao poder político. As soluções identificadas durante o trabalho passam essencialmente pela conformação do quadro jurídico interno aos instrumentos jurídicos internacionais e pela adoção de medidas concretas que visem o empoderamento político das mulheres. | pt_PT |
| dc.description.abstract | The main scope of this master's dissertation corresponds to an analysis of the international legal framework that is made of the right to political participation of women in Guinea-Bissau, in the perspective of the Universal Human Rights Protection System, namely, the United Nations Organization and Regional (African) Human Rights, namely the African Union. The equitable inclusion of men and women in political life, considering the principle of material equality consecrated in all legal instruments for the human rights protection, has a very important impact on the definition and implementation of national public policies that correspond to the interests of both groups. However, despite women being the predominant gender of the total world population, they are underrepresented in the decision-making spheres of their countries. This study sought to identify and analyze the rights granted to them by international legal instruments that aim to protect and promote their human rights in general and particularly their right to political participation in formal structures of power, The present work was dedicated to the study of the case of Guinea-Bissau, comparing the prescribed of such national and international legal instruments with the reality experienced by Bissau Guinean women. This study also sought to diagnose the obstacles to women's participation in politics in Guinea-Bissau and to what extent these obstacles contravene the provisions of international legal instruments for the protection of women's human rights. From the performed investigation, it was concluded that Guinea-Bissau has not been able to respect its international legal commitment in this matter due to a variety of obstacles that owe their existence to reasons of a political, legal, social, economic nature, but essentially due to cultural nature, due to the stereotypes imposed by society and the practice of cultural thoughts and practices that contravene the law and that constitute serious violations of women's human rights, considerably limiting their access to political power. The solutions identified during the work essentially involve conforming the internal legal framework to international legal instruments and adopting concrete measures aimed at the political empowerment of women. | pt_PT |
