Os historiadores têm o hábito de afirmar que o direito é história. Partindo de uma abordagem positivista, considerando que o direito é uma tecnologia inventada em locais e em momentos diferentes, parece mais apropriado afirmar que o direito tem histórias, diferentes em função das leituras dos fenómenos do passado. nesta perspetiva, uma das tarefas do método histórico aplicado ao direito é a de identificar e compreender os processos através dos quais a tecnologia jurídica foi inventada, as ordens jurídicas são impostas ou instituídas e as normas jurídicas desaparecem ou parecem bater em retirada. Para além da ordem jurídica, a pluralidade de aspetos do campo jurídico constitui a fonte inesgotável de um grande número de diferentes histórias do direito
Legal historians are accustomed to saying that law is history. Taking a positivistic approach and considering law as an invented technology (in different places and periods), it seems more convenient to affirm that law has histories, varying according to the interpretation of past phenomena. From this perspective, one of the tasks of an historical methodology applied to law is identifying and understanding the processes through which the legal technology is created, legal orders are imposed or displayed, and legal norms have disappeared or seemed to have beaten their retreat. Beyond the legal order, the plurality of aspects of the legal field is an inexhaustible source of a number of various legal histories
