Abstract(s)
A presente tese de doutoramento objetiva delinear os fundamentos, o conteúdo e a natureza jurídica do direito à igualdade racial. Parte-se do estudo da dignidade da pessoa humana, como fundamento do princípio igualitário, de cujas dimensões se podem extrair os feixes de prerrogativas jusfundamentais constitutivas da igualdade racial. Explorados o conteúdo jurídico e as funções da dignidade da pessoa humana, apresenta-se a noção de mínimo dignificante enquanto núcleo essencial estável, porém dinâmico, dos direitos fundamentais. As concepções de igualdade – como valor, como justiça, como princípio jurídico e como jus cogens – não impedem a sua compreensão também como direito fundamental, ou direitos de igualdade, aqui compreendido o direito à igualdade racial. Tratando mais especificamente da temática central, inicia-se por justificar a persistência da tutela jurídica da questão racial, haja vista cientificamente ter-se concluído não existirem raças humanas. Desvelando as concepções de racismo, raça e discriminação racial, a investigação dedica-se, posteriormente, a um breve histórico sobre as principais ideias políticas a respeito da igualdade racial. A partir dos pressupostos teóricos já absorvidos com o estudo da dignidade da pessoa humana e da igualdade, desvendam-se as dimensões constitutivas do direito à igualdade racial, sejam as de caráter eminentemente negativo, sejam as de caráter eminentemente positivo. Nesse sentido, serão explorados o direito à não discriminação racial; o direito à diferença racial; o direito à promoção da igualdade racial; e o direito à proteção da igualdade racial, enquanto dimensões integrantes do direito fundamental à igualdade racial no seu conteúdo ótimo. Nada obstante, o estudo não se furtará da tarefa de revelar também o conteúdo mínimo da igualdade racial, incontornável na atuação das entidades públicas e, em certa medida, das entidades privadas. Após tratar da constitucionalização da igualdade racial – nos sistemas internacionais de proteção dos direitos humanos e nas ordens jurídicas brasileira e portuguesa –, as últimas linhas do trabalho serão dedicadas ao estudo do regime jurisprudencial das dimensões da igualdade racial, no Brasil.
The present doctoral thesis aims to outline the foundations, the content and legal nature of the right to racial equality. The thesis begins with the study of human dignity, as the foundation of the equality principle, from whose dimensions we can extract the bundles of fundamental prerogatives that constitute the racial equality. Once explored the legal content and functions of human dignity, the notion of minimum of dignification is presented as a stable but dynamic core of fundamental rights. The conceptions of equality - as value, as justice, as juridical principle and as jus cogens – do not prevent its understanding as well as fundamental right or rights of equality, here included the right to racial equality. Treating more specifically the central theme, the thesis begins by justifying the persistence of legal protection of the racial issue, since scientifically have concluded that human races do not exist. Uncovering the conceptions of racism, race and racial discrimination, the research is subsequently dedicated to a brief history of the main political ideas regarding racial equality. From the theoretical assumptions already absorbed with the study of human dignity and equality, the study reveals the constituent dimensions of the right to racial equality, whether are those of eminently negative character, or eminently positive character. In this sense, it will explore the right to non- racial discrimination; the right to racial difference; the right to the promotion of racial equality; and the right to the protection of racial equality, dimensions that are part of the fundamental right to racial equality in its great content. Nevertheless, the study does not shirk the task of revealing also the minimum content of racial equality, essential in the performance of public entities and, to some extent, private entities. After treating the constitutionalisation of racial equality – in international systems of human rights protection and in brazilian and portuguese legal systems – the last lines of the work will be devoted to the study of the judicial regime of the dimensions of equality race, in Brazil.
