Abstract(s)
O objetivo do presente estudo Ă© analisar os limites Ă competĂȘncia do juiz constitucional, os quais por sua vez tambĂ©m consistem em limites Ă discricionariedade judicial, dentro de um cenĂĄrio em que se constata a ocorrĂȘncia de excessos na prĂĄtica de ativismo judicial por parcela do Poder JudiciĂĄrio brasileiro. Nesse estudo, a expressĂŁo ativismo judicial refere-se Ă s situaçÔes em que o juiz constitucional ultrapassa os limites de sua competĂȘncia constitucional, em detrimento principalmente da função legislativa, mas tambĂ©m da função administrativa, ou seja, em que o Poder JudiciĂĄrio exerce indevidamente o nĂșcleo essencial de funçÔes destinadas constitucionalmente a outros Poderes, em grave violação ao princĂpio da separação dos Poderes. Essa anĂĄlise Ă© dificultada tendo em vista que a competĂȘncia do juiz constitucional consiste em exercĂcio de função estatal com fronteiras volĂșveis e dinĂąmicas que, por vezes, tem sido violada por meio de excessos interpretativos que resultam em exercĂcio jurisdicional em desconformidade com os limites e parĂąmetros interpretativos estabelecidos pela prĂłpria Constituição, e menos perceptĂveis Ă sociedade em razĂŁo do grau de sofisticação e tecnicidade que caracterizam a Justiça Constitucional.
The aim of this study is to analyze the limits of jurisdiction power of constitutional judge, which in turn also consist of limits on judicial discretion, within a scenario where we see the occurrence of excesses in the practice of judicial activism by share of the Brazilian judiciary. In this study, the judicial activism term refers to situations in which constitutional judge exceeds the limits of its constitutional jurisdiction, mainly at the expense of the legislative function, but also of the administrative function, i.e., in which the judiciary has improperly exceeded the core functions of other constitutional powers, in serious violation of the principle of separation of powers. This analysis is difficult given that jurisdiction power of constitutional judge consists of performing a State function with volatile and dynamic borders that sometimes has been violated through interpretative excesses that result in exercise jurisdiction in breach of the limits and parameters set by the Constitution itself, and less noticeable to society because of the degree of sophistication and techniques that characterize constitutional justice.
