As reservas aos tratados internacionais são uma importante ferramenta para a manifestação de vontade dos Estados e Organizações Internacionais. Como forma de possibilitar a vinculação de partes cujas opiniões e interesses divergem, bem como salvaguardar a sua soberania, o regime das reservas surge para que o seu autor, ao vincular-se ao tratado, exclua ou modifique disposições específicas. No entanto, a sua utilização no âmbito dos tratados de direitos humanos, ainda que auxilie um alcance universal, pode violar a integridade das
suas obrigações. O facto da Convenção Contra todas as Formas de Discriminação contra as Mulheres ser um dos instrumentos de direitos humanos que mais foi objeto de reservas pode gerar impactos negativos na efetivação do direito das mulheres, pois demonstra o comprometimento das partes para com o seu objetivo. A universalidade dos direitos humanos não apenas requer o seu alcance global, mas o próprio objeto da Convenção, isto é, a proteção internacional de direitos das mulheres, impõe que as obrigações sejam
assumidas em sua totalidade. Na presente dissertação examinamos o regime das reservas codificado pela Convenção de Viena de 1969, principalmente quanto às suas regras e lacunas, com a finalidade de analisar a admissibilidade e aplicabilidade deste regime aos tratados de direitos humanos e, especialmente, à Convenção Contra todas as Formas de Discriminação contra as Mulheres.
Reservations to international treaties are an important tool in the expression of will of States and International Organizations. To allow the adherence of parties with dissenting opinions and interests, as well as safeguarding its sovereignty, the reservations regime enables the author, upon expressing its consent to be bound to the treaty, to exclude or to modify specific provisions. However, its practice on human rights treaties, while it facilitates the reach of universality, it may also violate the integrity of the treaty obligations. The fact that the Convention on the Elimination of All Forms of Discrimination against Women is one of the most reserved human rights instruments creates negative impacts on the achievement of women's rights, because it demonstrates the commitment of the parties to its objective. The universality of human rights not only requires their global reach, but the very object of the Convention, which is the international protection of women's rights, requires that the obligations need to be assumed in their entirety. In the present dissertation we examine the reservations regime codified by the 1969 Vienna Convention on the Law of Treaties, mainly regarding its rules and gaps, in order to analyse its admissibility to human rights treaties and, especially, to the Convention on the Elimination of All Forms of Discrimination against Women.
