O presente trabalho de mestrado tem como foco a análise da responsabilidade civil decorrente da violação do dever conjugal de fidelidade, abordando o tema sob a perspectiva do direito português e brasileiro. A infidelidade conjugal, embora de natureza íntima, pode gerar repercussões jurídicas relevantes, especialmente no que diz respeito aos danos causados ao cônjuge traído. O estudo busca compreender as bases jurídicas que sustentam a responsabilidade civil nesse contexto, examinando a evolução histórica e as nuances legislativas e jurisprudenciais pertinentes nos sistemas legais de Portugal e do Brasil. A pesquisa se propõe a identificar as semelhanças e diferenças nas abordagens adotadas por ambos os ordenamentos, destacando as peculiaridades culturais e sociais que podem influenciar a compreensão e aplicação do direito no âmbito da infidelidade conjugal. Além disso, serão analisadas as possíveis soluções jurídicas oferecidas pelos tribunais diante de casos envolvendo violação do dever de fidelidade, visando contribuir para o aprimoramento da compreensão e aplicação do direito civil no contexto matrimonial.
This master's thesis focuses on the analysis of civil liability arising from the violation of the conjugal duty of fidelity, addressing the issue from the perspective of Portuguese and Brazilian law. Infidelity, although of an intimate nature, can have significant legal repercussions, especially regarding the damages caused to the betrayed spouse. The study aims to understand the legal foundations that support civil liability in this context, examining the historical evolution and the legislative and jurisprudential nuances relevant to the legal systems of Portugal and Brazil. The research aims to identify similarities and differences in the approaches adopted by both legal frameworks, highlighting the cultural and social peculiarities that may influence the understanding and application of law in the context of conjugal infidelity. Additionally, the study will analyze possible legal solutions offered by the courts in cases involving a breach of the duty of fidelity, aiming to contribute to the improvement of the understanding and application of civil law in the marital context.
