O ensino obrigatório como dever fundamental no estado constitucional democrático

A tese tem como escopo demonstrar que o ensino obrigatório é um dever fundamental num Estado Constitucional Democrático, na medida em que o acesso à instrução obrigatória desperta o cidadão ao exercício de suas responsabilidades e o prepara para exercer a cidadania. A superação da crise do Estado do Mal-Estar Social (Estado Assistencialista) ocorrerá pelo respeito aos deveres fundamentais, onde os cidadãos exercerão suas liberdades com responsabilidade, observando-se a escolaridade obrigatória de qualidade, uma vez que democracia de qualidade depende de educação de qualidade. O trabalho não busca discutir solidariedade educacional, mas sim compromisso constitucional na educação de qualidade da coletividade, visando minimizar os efeitos do subdesenvolvimento educacional demonstrado em resultados junto aos organismos internacionais. No Estado Constitucional contemporâneo, a escolaridade obrigatória não visa apenas inibir os efeitos do analfabetismo total ou funcional, mas fortalecer os princípios constitucionais que regem a cidadania participativa no Estado Democrático. O Estado Constitucional precisa de um cidadão cada vez mais preparado para atender às expectativas da coletividade, razão ela qual está havendo alargamento do período considerado como ensino obrigatório, com a introdução de matérias no eixo de formação do cidadão que visam discutir os princípios que regem o Estado Democrático de Direito.
The scope of the thesis is to demonstrate that compulsory education is a fundamental duty in a Democratic Constitutional State, to the extent that access to compulsory education awakens the citizens to the exercise of their responsibilities and prepares them to exert citizenship. The overcoming of the Bad Welfare State crisis (Welfare State) will take place with the respect for fundamental duties, where citizens exercise their freedoms with responsibility, caring for the quality compulsory education of others. The work does not seek to discuss educational solidarity, but constitutional commitment to community education in order to minimize the educational underdevelopment demonstrated on the results from international bodies‘ evaluations. In the contemporary Constitutional State, compulsory education aims not only to inhibit the effects of total or functional illiteracy, but strengthen the constitutional principles governing the Democratic State - participatory citizenship. The Constitutional State needs an increasingly prepared citizen to meet the expectations of the community. The basic task of education translates into a heteronomous limit to the constitutional power; a trans-dimensional fundamental duty; right and duty of parents; stems from essential, free, universal and quality public service; subjective public right.
