Abstract(s)
O presente trabalho trata do uso desregrado do Poder Judiciário, decorrente da interpretação abrangente e sem limites do direito fundamental de acesso à justiça. Propôs-se a aplicação das normas de conformação e técnicas de limitação aos direitos fundamentais, como a reserva legal e o princípio da proporcionalidade em sentido amplo, de modo a resolver parte dessa celeuma. Em termos metodológicos, foi utilizado o método de abordagem dedutivo, optando-se pela pesquisa estatística, bibliográfica e jurisprudencial. Apresentou-se a estatística, elaborada pelo Conselho Nacional de Justiça e relacionada ao Judiciário brasileiro. Há um resultado negativo com a utilização nociva e desenfreada do direito fundamental de acesso à justiça. Verificou-se o aumento excessivo de demandas, muitas das quais poderiam ser solucionadas por meio de métodos extrajudiciais, como acordos, procura dos órgãos administrativos, notificações extrajudiciais, arbitragem, etc. Há alguns anos, o Brasil vem repensando as causas do ajuizamento desenfreado de tantas ações, as quais trazem como um dos problemas, a impossibilidade de uma rápida solução dos litígios, o que pode, inclusive, comprometer a efetividade do direito no caso concreto. Elencaram-se pontos que propiciam o ajuizamento desregrado de ações, de forma direta ou indireta, e que devem ser repensados, entre eles a facilidade de se obter a gratuidade da justiça sem provas da hipossuficiência, o ativismo judicial e as ações sem comprovação de prévio requerimento administrativo, como demonstração do interesse processual.
This paper deals with the unruly use of the Judiciary Power, resulting from the comprehensive and unlimited interpretation of the fundamental right of access to justice. It was proposed to apply the rules of conformation and techniques for limiting fundamental rights, such as the legal reserve and the principle of proportionality in a broad sense, in order to resolve part of this stir. In methodological terms, the deductive approach method was used, opting for statistical, bibliographic and jurisprudential research. The statistics prepared by the National Council of Justice and related to the Brazilian Judiciary were presented. There is a negative result with the harmful and unrestrained use of the fundamental right of access to justice. There was an excessive increase in demands, many of which could be resolved by means of extrajudicial methods, such as agreements, demand from administrative bodies, extrajudicial notices, arbitration, etc. For some years, Brazil has been rethinking the causes of the unrestrained filing of so many actions, which bring as one of the problems the impossibility of a quick resolution of the disputes, which can even compromise the effectiveness of the law in the specific case. Listed points that favor the unruly filing of actions, directly or indirectly, and that must be rethought, among them the ease of obtaining free justice without evidence of hyposufficiency, judicial activism and actions without previous proof. administrative request, as a demonstration of procedural interest.
