A violência obstétrica tem vindo a ganhar crescente visibilidade fruto de denúncias de mulheres sobre abusos e desrespeitos durante o acompanhamento da gravidez e o parto. Em Portugal, as denúncias dizem respeito, na sua larga maioria, à excessiva medicalização do parto, nomeadamente à realização de episiotomias de rotina. A presente dissertação pretende dar conta do estado da arte da responsabilização civil e penal dos profissionais de saúde pela realização de episiotomias de rotina e abordar a necessidade, ou não, da implementação de mecanismos jurídicos, no âmbito civil e penal, de forma a assegurar a tutela dos direitos das parturientes face a esta prática contrária às leges artis.
Obstetric violence has been gaining increased visibility due to women's reports of abuse and disrespect during medical care throughout pregnancy and childbirth. In Portugal, the vast majority of reports relate to the excessive medicalization of childbirth, particularly the routine performance of episiotomies. This dissertation aims to provide an overview of the current state of civil and criminal accountability of medical professionals for the practice of routine episiotomies and to assess the need, or lack thereof, for implementing civil and criminal mechanisms to ensure the protection of women's rights against this leges artis violation.
