Abstract(s)
A presente pesquisa tem como foco a análise do direito à educação no plano internacional, ou seja, com cidadão de uma sociedade internacional globalizada, frente aos tratados internacionais de Direitos Humanos. Nesse sentido, mesclamos o direito à
educação com o dever que os Estados têm de promovê-lo aos cidadãos, estabelecendo
uma relação direta da promoção da educação com o desenvolvimento humano e fazendo
com que as Organizações Internacionais também empenhem esforços para atingir
objetivos positivos no campo da educação entre seus Estados-membros. Para atingir os
objetivos, faremos uma pesquisa interdisciplinar, abordando como principal, e majoritária, área o Direito, tratando, ainda, de assuntos no campo da Política, da História e das Relações Internacionais. No primeiro capítulo fizemos uma abordagem geral acerca da educação, tratando também dos objetivos e metas globais traçados pelas Nações Unidas.
No segundo capítulo abordamos os Direitos Humanos no plano Internacional. No terceiro capítulo fizemos uma conexão dos temas “educação” e “Direitos Humanos”,
abordando a evolução histórica de cada um. No quarto capítulo estudamos a educação
como um direito do cidadão e um dever do Estado. No quinto capítulo apresentamos os
problemas que afetam negativamente o Direito à Educação, impedindo a efetivação do
direito. Por fim, no sexto capítulo, passamos a analisar a Comunidade dos Países de Língua Portuguesa, fazendo, de início, um paralelo entre educação e desenvolvimento
humano e, depois, analisando a situação dos seus Estados-membros em relação ao IDH
divulgado em relação ao ano de 2012 pelo Relatório de Desenvolvimento Humano pelo
PNUD. Finalizamos o trabalho apresentando possibilidades de esforços que a
Comunidade pode fazer para incentivar a promoção da educação através de normas de
Direito Internacional.
This research focuses on the analysis of the right to education on an international level, as a citizen of a globalized international society, compared to international human rights treaties. In this sense, the right to education merged with the duty that states have to promote it to the people, establishing a direct relationship with the promotion of education and human development causing international organizations also to commit efforts to achieve positive goals in the educational field among its Member States. To achieve the goals, we will make a interdisciplinary research addressing the main, and majoritary, area the Law, dealing also with issues in the field of Politics, History and International Relations. In the first chapter we made a general approach regarding education, addressing also the overall goals and objectives outlined by the United Nations. In the second chapter we discuss Human Rights in na International plan. In the third chapter we made a connection of "education" and "Human Rights" themes, addressing the historical evolution of each. In the fourth chapter we studied education as a civil right and a duty of the State. In the fifth chapter we present the problems that negatively affect the right to education, preventing the realization of the right. Finally, in the sixth chapter, we analyze the Community of Portuguese Language Countries, causing, at first, a parallel between education and human development, and then, analyzing the situation of its member states in relation to the HDI disclosed in relation to the year 2012 by the Human Development Report by UNDP. We end by presenting possibilities of efforts that the Community can do to encourage the promotion of education through international legal norms.
