Abstract(s)

Na presente dissertação, em primeiro lugar faz-se uma ilustração da evolução do Direito Internacional e da sua função na protecção da paz Mundial desde os finais do Séc. XIX até aos dias de hoje. Nesse sentido, discute-se a importância da personalidade jurídica internacional no âmbito das Organizações Internacionais explanando o porquê de ele ser um elemento chave na sua constituição. Neste ponto, apresenta-se de forma inovadora uma nova visão jurídica da Sociedade das Nações fazendo um ponto comparativo com a actual Organização das Nações Unidas. Com esta análise, consegue-se concluir, em primeiro lugar, a importância do Direito internacional na protecção da paz Mundial. Consecutivamente alcança-se uma nova perspectiva da real natureza da Sociedade das Nações e da importância das questões jurídicas na sua implosão, nomeadamente a questão fundamental da personalidade jurídica Internacional. Em terceiro lugar, naquele que será o ponto mais actualista, procede-se à análise histórico-jurídica comparativa entre a Sociedade das Nações e a Organização das Nações Unidas que permite estabelecer uma conexão essencial para a compreensão do actual sistema da Organização das Nações Unidas enquanto representante da Comunidade Internacional e protector da Paz Mundial.

In this dissertation, we shall firstly illustrate the evolution of the internationallaw and its role in the protection of the world peace from the end of the 19th centuryup to the present era. In this sense, it is discussed the importance of international legalpersonality in the scope of Organizations explaining why it is a key element in its ownconstitution. In this respect, a new legal vision of the League of Nations is presented in an innovative way, making a comparative point with the current United Nations Organization. With this analysis one can assume the conclusion, first and foremost, of the importance of international law in the protection of world peace. This brings us to a new perspective on the real nature of the League of Nations and the importance of legal issues in its implosion, namely the fundamental question of international legal personality. Thirdly, in the most actualist perspective, the comparative historical-legal analysis between the League of Nations and the United Nations Organization, which provides an essential link for understanding the present system of the United Nations as on one hand the representative of the Community International and at the same time the Protector of World Peace.
