O presente trabalho de pesquisa visa o estudo das novas organizações familiares da contemporaneidade, especialmente as uniões convivenciais, nominadas no Brasil de uniões estáveis e em Portugal de uniões facto, sua tutela e regulamentação pelo ente estatal. A referência aos novos modelos de entidades familiares visa demonstrar a mutação da sociedade sobre a qual o Direito não pode silenciar. É sabido que vivemos um momento de passagem da era moderna à pós moderna e como em todo momento de passagem, inúmeras discussões são formadas ao entendimento do novo. Tema bastante recorrente na atualidade dá-se a tutela das famílias simultâneas, uma vez que resistem na doutrina pensamentos há defender sua aceitação, tantos quantos resistem aos que entendem nessa possibilidade uma afronta aos princípios da família ocidental. Assim, a pesquisa se justifica na necessidade de apresentar as mais variadas opiniões sobre o tema das uniões convivenciais plúrimas, partindo do que está posto por consagração da Lei até o que vida consumou.
This research work aims to study the new family organization in the contemporary scenario, especially the unions based on coexistence, that are nominated in Brazil of “uniões estáveis” and in Portugal of “uniões facto”, its protection and regulation by the State. The focus on the new models of family aims to demonstrate a mutation on the society that the law cannot ignore. It is known that we live in a time of transition from the modern era to the post-modern era and, as in every transition moment, numerous discussions are made until a new understanding is been reached. Currently, the subject of simultaneous family is treated by the doctrine and the opinions are divided between those who accept the need of protection and those who resist to this concept supported by the idea that it goes against the principles of the traditional occidental family. Thus, the importance of this work is justified by the necessity to expose different arguments about the simultaneous unions based on coexistence, starting from what is enshrined in law to what is consummated by life.
