Investigar factos e circunstâncias que motivaram a criação, o formato e a evolução do Estado Novo brasileiro (1937 – 1945) é essencial para conhecê-lo plenamente. E conhecê-lo plenamente implica entender as mutações do ordenamento jurídico e o modelo estatal imposto, àquela altura, à nação, quando já havia no decênio de 1930 uma forte interação entre Brasil e Portugal, notadamente os laços culturais que se fortaleceram ao longo de todo o período Vargas, entre 1930 e 1945. O pensamento político e católico circulante em Portugal no século XX é significativo a ambos os regimes de tradição católica, e as ações governamentais ocorridas na terra lusitana são de capital importância à compreensão da política e ao direito dos dois países. Também a crise do liberalismo na transição do século XIX ao século XX, acentuada com o fim da I Guerra Mundial, a ascensão do regime comunista na Rússia em 1917 e do fascismo na Itália em 1922, a instabilidade econômica mundial deflagrada com o crash da Bolsa de Valores de Nova York em 1929, são fatores de contribuição ao pensamento político de Brasil e Portugal (e a outros também, v.g., Alemanha), e na criação de instituições e diplomas legais, alguns referidos nesta dissertação.
O diálogo jurídico e o contributo português na criação e condução do Estado Novo de Vargas emergirão ao longo deste trabalho, para assim revelar a influência do Portugal de Salazar naquele processo autoritário e corporativo, vivenciado pelos brasileiros entre 1937 e 1945. Mediante a análise das circunstâncias que envolveram os dois países naquele período, e antes até, somados aos achados documentais e bibliográficos, a pesquisa demonstra, precisamente, que houve diálogo jurídico e contributo português na criação e condução do Estado Novo de Vargas. Houve igualmente influência do Portugal de Salazar naquele processo autoritário e corporativo vivenciado pelos brasileiros no período supra. Enfim, será uma oportunidade de se entender, através deste trabalho, a dinâmica dos interesses políticos, sociais e jurídicos no âmbito nacional, mediante o estudo da História e do Direito.
Investigation of facts and circunstances that led to the creation, shape and evolution of the so called “Estado Novo Brasileiro” (Brazilian New State, 1937 – 1945) are essential to achieve a complete understanding and deep knowledge of the Regimen. This means understanding the mutations of the juridical order and state model, imposed to the nation at that time, when in the 1930 decade there was already a strong interaction between Brazil and Portugal, specially due to the cultural bonds, which became stronger during Vargas’ period, from 1930 and 1945. Political and catholic ideologies, dominant in Portugal in the XX Century, were significant for both regimens of catholic tradition and governamental actions taken in Portugal were of major importance for comprehension of policies and rights of both countries. Besides, the crisis of liberalism, in the transition from the XIX to the XX Century, was intensified with the end of the World War I, increase of facism in Italy, in 1922, the communist implantation in Russia, in 1917, world economic instability triggered by the crash of the New York Stock Exchange in 1929. All this contributed to the development of political ideologies in Brazil, Portugal and others like Germany, with the creation of Institutions and legal diplomas. The “juridic dialogue” and the Portuguese contribution in the creation and conduction of Vargas’ New State reveal the influence of Salazar in the formation of the Vargas’ dictatorship as well as in the conduction of its juridic system.
