O presente artigo examina o princípio da igualdade entre os cônjuges à luz do Direito Comparado. Coloca em evidência os dois modelos fundamentais de relações entre cônjuges que a comparação jurídica permite identificar a este respeito: o modelo hierárquico, com longo enraizamento nas tradições jurídica hindu, chinesa, islâmica e africana e também adotado durante largo período de tempo na família jurídica romano-germânica; e o modelo igualitário, oriundo da
família jurídica anglo-americana, o qual encontrou também expresso acolhimento nos sistemas jurídicos socialistas e, mais recentemente, na família jurídica romano-germânica. Analisam-se em seguida as perspetivas atuais de superação de ambos os modelos
This paper examines the principle of equality between spouses in the light of Comparative Law. It underscores the two fundamental models of matrimonial relationships that can be identified through legal comparison: the hierarchical model, deeply rooted in the Hindu, the Chinese, the Islamic and the African legal traditions, as well as, for a tong period oftime, in the Roman-German legal family; and the egalitarian model, which stems from the Anglo-American legal family and which has also found express recognition in socialist legal systems and, more recently, in the Roman-German legal family.
