A protecção e promoção dos direitos e liberdades fundamentais representam um dever do Estado, sendo o direito à habitação um pilar essencial para a dignidade humana e o desenvolvimento social, conforme consagrado na Constituição da República de Angola e em instrumentos internacionais de direitos humanos. Esta dissertação tem como objetivo analisar o grau de efetivação deste direito em Angola, partindo de uma abordagem teórica que explora seu conceito, conteúdo jurídico e limites impostos pela “reserva do possível” e pelo princípio da proibição da insuficiência, que servem como parâmetros para avaliar o cumprimento das obrigações estatais. O estudo procede a uma avaliação crítica das políticas habitacionais implementadas em Angola, identificando os principais obstáculos ao acesso à habitação digna, como o rápido crescimento urbano desordenado, a insuficiência de infraestruturas básicas e as desigualdades socioeconómicas, factores que comprometem a realização plena deste direito social. A pesquisa adopta uma metodologia mista, combinando análise documental de legislação e políticas públicas com uma abordagem prescritiva que propõe soluções para melhorar a eficácia das acções governamentais, destacando-se a necessidade de maior participação comunitária em programas de autoconstrução e um planeamento urbano mais integrado, alinhado com as metas do ODS 11 da Agenda 2030. A dissertação demonstra como a insuficiência de políticas habitacionais adequadas não apenas viola um direito constitucionalmente garantido, mas também prejudica o exercício de outros direitos fundamentais, como saúde, educação e segurança, perpetuando ciclos de pobreza e exclusão. Conclui-se que a superação dos desafios no sector habitacional angolano exige não apenas maior investimento público, mas também uma governação mais transparente e participativa, com mecanismos eficazes de fiscalização e maior envolvimento da sociedade civil na formulação e implementação de políticas, visando assegurar o acesso universal à habitação adequada como condição indispensável para o desenvolvimento humano sustentável e a justiça social.
The protection and promotion of fundamental rights and freedoms represent a duty of the State, with the right to housing being an essential pillar for human dignity and social development, as enshrined in the Constitution of the Republic of Angola and international human rights instruments. This dissertation aims to analyse the degree to which this right has been realised in Angola, based on a theoretical approach that explores its concept, legal content, and the limitations imposed by the "reserve of the possible" and the principle of prohibition of insufficiency, which serve as parameters for assessing the fulfilment of state obligations. The study conducts a critical evaluation of housing policies implemented in Angola, identifying the main obstacles to accessing adequate housing, such as rapid and unplanned urban growth, insufficient basic infrastructure, and socioeconomic inequalities—factors that hinder the full realisation of this social right. The research adopts a mixed methodology, combining documentary analysis of legislation and public policies with a prescriptive approach that proposes solutions to improve the effectiveness of government actions. Key recommendations include greater community participation in self-build programmes and more integrated urban planning, aligned with the targets of SDG 11 of the 2030 Agenda. The dissertation demonstrates how the inadequacy of proper housing policies not only violates a constitutionally guaranteed right but also undermines the exercise of other fundamental rights, such as health, education, and security, perpetuating cycles of poverty and exclusion. It is concluded that overcoming the challenges in Angola's housing sector requires not only greater public investment but also more transparent and participatory governance, with effective oversight mechanisms and increased civil society involvement in policy formulation and implementation. The goal is to ensure universal access to adequate housing as an indispensable condition for sustainable human development and social justice.
