Abstract(s)
A presente Dissertação de Mestrado aborda o tema da criminalização do enriquecimento ilícito desde a sua origem, analisando o surgimento do debate legislativo em Portugal e a sua evolução. Este debate teve como ponto alto a apreciação da conformidade constitucional deste novo tipo de crime por parte do Tribunal Constitucional. No presente trabalho de investigação estarão em foco as orientações dos diversos partidos
políticos que se dedicaram à elaboração de projetos de lei com o intuito de criminalizar o enriquecimento ilícito, a doutrina que se pronunciou sobre o tema, bem como os principais pareceres elaborados sobre este assunto por parte de algumas instituições.
Será igualmente analisado o tipo de crime, a sua constitucionalidade, necessidade e eficácia. Para esse efeito, iremos fazer uma apreciação crítica sobre o acórdão do Tribunal Constitucional que se pronunciou em sede de fiscalização preventiva sobre este novo tipo de crime e iremos debruçar-nos sobre os vários princípios constitucionais que com ele poderão colidir.
This Master's Dissertation addresses the issue of the criminalization of illicit enrichment from its origin, analyzing the emergence of the legislative debate in Portugal and its evolution. This debate had its highlight with the appreciation of the Constitutional Court on the constitutional compliance of this new type of crime. This research work will focus on the guidelines of the various political parties who were dedicated to the preparation of bills aiming the criminalization of illicit enrichment, the doctrine that has ruled on the issue, as well as major developed opinions on this subject by some institutions. It will also be examined the type of crime, its constitutionality, its necessity and effectiveness. To this end, we will make a critical appreciation of the judgment of the Constitutional Court that has addressed about the preventive control of constitutionality of this new type of crime and we will dwell on the various constitutional principles that may collide with it.
