No presente trabalho estuda-se a concretização da dimensão ressocializadora no sistema prisional português.
Parte-se das teorias dos fins das penas e do modo como estes se encontram consagrados no Código Penal Português. Seguidamente, estuda-se os diferentes modelos de política criminal e os princípios subjacentes ao modelo português. Para o mesmo efeito, procura-se estabelecer o conceito de ressocialização e respetivos limites. Num momento posterior, procura-se uma apreciação empiricamente fundada da ressocialização na execução da pena de prisão, com base na experiência obtida no estágio no Tribunal de Execução das Penas de Lisboa e, concretamente, no exame dos dados recolhidos quanto ao Estabelecimento Prisional de Sintra. Para o efeito, reflete-se acerca dos resultados obtidos, mediante a sua descrição em termos absolutos e a sua análise em termos comparativos, designadamente por referência aos dados disponíveis acerca do sistema prisional em geral. Os resultados são ainda apreciados quanto ao modo como podem refletir, ou não, o cumprimento das regras do Direito português quanto aos fins das penas, maxime na vertente da ressocialização, no que à pena de prisão em particular diz respeito. Concomitantemente, constata-se a existência de uma falha no processo de ressocialização que se entende estar associada ao não cumprimento do objetivo de evitar a dessocialização dos reclusos. A causa do fenómeno surge identificada com a
massificação e industrialização das prisões. Por fim, com vista à resolução do problema que se detetou, propõe-se a reconfiguração das prisões, com a criação de estabelecimentos de pequena dimensão, com
acompanhamento e ambiente ajustados a combater a assinalada dessocialização dos reclusos. Para tanto, alude-se ao modelo dos projetos desenvolvidos noutros países.
This paper studies the resocialization dimension in the Portuguese prison system. We start by analysing theories about end of sentences and the way in which they are depicted in the Portuguese Penal Code. Then, the different models of criminal policy and the underlying principles of the Portuguese model are studied. Furthermore, we establish the concept of resocialization and its limits. Subsequently, an empirically founded appreciation of resocialization in the execution of the prison sentence is sought, based on the experience acquired during an internship at the Lisbon Court of Execution of Sentences and, specifically, on the examination of the data collected regarding the Sintra Prison. For this purpose, we reflect on the results obtained, through their description in absolute terms and their analysis in comparative terms, namely by referring to the available data about the prison system in general. These results are also considered in terms of how they may reflect, or not, compliance with the rules of Portuguese law regarding the ends of sentences, maxime in terms of resocialization, regarding the prison sentence in particular. Afterwards, we identify a failure in the resocialization process that is associated with the non-fulfilment of the objective of avoiding the desocialization of inmates. The cause of this phenomenon is connected with the massification and industrialization of prisons. Finally, with the purpose of solving the problem that has been identified in mind, a reconfiguration of prisons is suggested, with the creation of smaller-scale establishments, with closer monitoring and an environment adjusted to combat the aforementioned desocialization of inmates. For this, we look outwards, for models developed in other countries.
